Dear Honorable Talton:
The self -reported Sanitary Sewer Overflow (SSO) 5-Day Report submitted by Town of Mount Olive indicates
violations of permit conditions stipulated in the subject permit and North Carolina G.S. 143-215.1. Violations include
failing to effectively manage, maintain, and operate the subject collection system so that there is no SSO to the
land or surface waters and making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for
which a permit is required.

This letter is to inform you that the Special Order by Consent contains a stipulated penalty of $5000 per violation.
Paragraph 4 of the Consent Order states in part that the stipulated penalties are not due if the Town satisfies the
Division that on -compliance was caused by events or circumstances beyond the Town's control as outlined in the
SOC.
If you have justification that this violation was caused by events or circumstances beyond the Town's control, you
must reply in writing to the Washington Regional Office within ten (10) days after receipt of this Notice. Your
justification will be reviewed, and a recommendation forwarded to the Director for their consideration. In the
absence of such justification, this Office shall proceed with recommendations that the Director demand payment of
the stipulated penalty as included in the Consent Order.
