Violations include failing to effectively manage, maintain, and operate the subject collection system so that there is no SSO to the land or surface waters and making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for which a permit is required. Paragraph 4 of the Consent Order states in part that the stipulated penalties are not due if the Town satisfies the Division that on -compliance was caused by events or circumstances beyond the Town's control as outlined in the SOC. If you have justification that this violation was caused by events or circumstances beyond the Town's control, you must reply in writing to the Washington Regional Office within ten (10) days after receipt of this Notice. Your justification will be reviewed, and a recommendation forwarded to the Director for their consideration. In the absence of such justification, this Office shall proceed with recommendations that the Director demand payment of the stipulated penalty as included in the Consent Order.
