Talton, Mayor Town of Mount Olive PO Box 939 Mount Olive, NC 28365-0939 Subject: Case No. SP-2023-0032 Department of Environmental Quality vs. Town of Mount Olive, Stipulated Penalty Demand for Violation of Consent Order EMC SOC S20-002; NOV-2022-SP-0004 Wayne County Dear Mr. Talton: On October 14, 2021, Mount Olive entered Special Order by Consent S20-002 with the North Carolina Environmental Management Commission whereby the Town of Mount Olive WWTP and collection system (Permit No. WQ0029169, Permit No, WQCS00129, Permit No. NC0020575) is not capable of consistently meeting effluent limits in the current permits due to infiltration/inflow and treatment issues. Upon review of the deadline established in Section 2(b) of the SOC for submittal of quarterly progress reports, I have concluded that a quarterly progress report was not submitted by May 1, 2022, as was noted in the Notice of Violation (NOV-2022-SP-0004) issued to the Town of Mount Olive on June 2, 2022. Paragraph 3 of the SOC contains a stipulated penalty of $1,000 for the first violation with the penalty doubling for each violation thereafter. The calculated penalty for the violation listed above was given as $1,000 dollars in NOV-2022-SP-0004.
