associated with a proposed solar array in Battleboro, Edgecombe County. Stream impacts result from the
placement of a culvert in an intermittent stream for a fence crossing. No impacts to wetlands or Tar - Pamlico
riparian buffers are proposed.

3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application:
Most of the site is currently in cultivated cropland, with an approximately 6 acre forested area bisecting the property. The
site is located on the outskirts of Battleboro and the prevailing land uses in the vicinity are agriculture (cropland and
pasture), forest land (cultivated pine timber land and mixed pine- hardwood and bottomland hardwood forests), and light
manufacturing (Berry Plastics).

3d. Explain the purpose of the proposed project:
The project's purpose is to install a 5 megawatt, ground- mounted solar photovoltaic array. A fence will be erected around
the property to contain sheep that will provide a way to maintain and control vegetation once grass is re- established on
site after construction.
3e. Describe the overall project in detail, including the type of equipment to be used:
The proposed site improvements consist of installing ground- mounted, fixed -tilt solar panels, three concrete
equipmentfinverter pads and perimeter fencing. Typically, for ground - mounted solar systems, the panels are installed
2' to 3' above finished grade (in this case existing grade, because no grading is being performed), and mounted on a
steel -frame racking system supported by posts which are driven into the ground.
The fencing will be installed around the perimeter of the array area as indicated on the construction plans. Each fence will
be 6' high and consist of gate, end, corner and line posts of various diameters. The screen will consist of 11.5 gauge
chain link wire fabric attached to the posts with fabric ties. All posts will be encased in deep concrete piers, while a center
slab will be poured at the gate entrance.
After construction, and once vegetation has been reestablished, sheep will be introduced to the site in order to maintain
and manage the newly formed vegetation. Due to the utilization of livestock for vegetation maintenance, an HDPE culvert
will need to be placed within the jurisdictional stream in order to prevent the livestock from leaving the site through the
stream under the fence, while simultaneously preserving the existing drainage pathway.
Typical equipment/machinery used for installation includes:
• Pile drivers for the installation of the posts for the racking system,
• Backhoes to dig the trenches for any underground electrical lines,
Concrete trucks to pour the concrete equipment/inverter pads;
Forklifts to move the racking system /solar equipment;
Dump trucks for aggregate to be used on temporary construction entrances /permanent driveway entrances.

A site visit in response to a JD request was conducted with the Corps on February 5, 2015. Based on design plans
forwarded to the Corps by Kleinfelder on March 27, 2015 showing no impacts, it was determined to file the project and not
issue a paper JD. A Tar - Pamlico buffer determination was issued by NCDWR on February 20, 2015.

Project avoids impacts to wetlands and riparian buffers on -site; solar panels will not be placed within 50 ft. of jurisdictional
stream, even in those areas that are not currently forested; minimal grading is required on -site; culvert length is only 10
ft.; a flared end - section will be placed at the downstream side of the culvert, which helps to mitigate erosion /scouring; on
the upstream end of the culvert, horseshoe inlet protection is proposed to mitigate any sedimentation build up.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
All land disturbing activities will be conducted in accordance with NCDENR standards; installation of temporary erosion
control measures including a perimeter silt fence and 'filter sock' (sheet C -6) outside jurisdictional wetlands and riparian
buffers; any excavations performed during grading operations will be backfilled the same day; grading and trenching for
inverter pad on site will have temporary ground cover at the end of each work day.

dispute a determination made by the DWR or Delegated Local Authority may request a determination by the
Director. An appeal request must be made within sixty (60) days of date of this letter or from the date the affected
party (including downstream and /or adjacent owners) is notified of this letter. A request for a determination by the
Director shall be referred to the Director in writing c/o Karen Higgins, DWR WeBSCaPe Unit, 1650 Mail Service
Center, Raleigh, NC 27699.
This determination is final and binding unless, as detailed above, you ask for a hearing or appeal within sixty (60)
days.
The owner /future owners should notify the Division of Water Resources (including any other Local, State, and
Federal Agencies) of this decision concerning any future correspondences regarding the subject property (stated
above). This project may require a Section 404 /401 Permit for the proposed activity. Any inquiries should be
directed to the Division of Water Resources (Central Office) at (919)- 807 -6300, and the US Army Corp of Engineers
(Raleigh Regulatory Field Office) at (919) - 554 -4884.
