Dear Mr. Hennessy,
The Town of Mount Olive's Gordon Street Water Treatment Plant(WTP)holds an NPDES permit for the
direct discharge of backwash water from the WTP. The backwash line is also connected to the Town's
sanitary sewer collection system, giving the WTP the option to either direct discharge or discharge to the
wastewater treatment plant. For the recent past, the WTP has opted to discharge the flow to the
wastewater treatment plant. During this time period, there were occasions in which the WTP failed to
submit DMRs for the months in which "no flow" conditions occurred. The Town was issued an NOV
and subsequent Civil Penalty for violations of the NPDES reporting requirements.
The Town is requesting that the civil penalty be waived or reduced. There has been no direct discharge
from the facility and accordingly, no adverse environmental impacts. The Town has requested that the
subject permit be rescinded and that the NPDES permit for the Town's WTP #3 (NPDES NC0003051)
also be rescinded.
