We also request written concurrence from the North Carolina Division of Water Quality that the project complies with GC 3402. A Pre-construction Notification Application (PCN) is attached, which includes an agent authorization form. Project Location The site is located on the western side of Powhatan Road (S.R. 1901) approximately 2500 feet from its intersection with Highway 70 in City of Clayton, in Johnston County, NC. See Figures 1 and 2. An existing Novo Nordisk facility is currently located on the site. The property is approximately 46 acres in size. Project History S&EC delineated the wetlands and stream channels located on the property, and a site meeting was then held on September 29, 2004 with Mr. Kevin Yates of he USACE. A wetland survey has been submitted to the USACE for approval. It was also determined that the existing stormwater pond on-site is not jurisdictional, and will therefore continue 6 October 13, 2004 ® S&EC Project #6324.W1 October 13, 2004 S&EC Project #6324.W1 Page 2of3 to be used for stormwater. A meeting was held with Bob Zarzecki of the NC-DWQ on June 30, 2004 to discuss the project, present its status, and solicit input and guidance regarding storm water treatment and this request. Our client has agreed to implement all the suggestions we mutually developed regarding the proposed facilities expansion. A major buffer variance was requested and approved earlier today. Impact Justification The production of insulin is strictly regulated by the U. S. Food and Drug Administration (FDA) under requirements defined as Good Manufacturing Practices (GMP) in 21 CFR Parts 210 and 211. According to GMP requirements the flow of components, drug products, and personnel through the building or buildings shall be designed to prevent contamination. In its current configuration the Novo Nordisk facility prevents product contamination by establishing cascading pressure differentials from the interior of the building outward and through strict hygiene and gowning requirements for personnel. In order to meet increased patient demand for insulin, Novo Nordisk must expand the existing production facility. A portion of the proposed expansion will include new packaging and warehouse space that services our current process. To maintain the integrity of the current contamination controls and eliminate risks associated with personnel and product movement through contaminated areas, it is imperative that building continuity be maintained. Building expansion to the east and south are restricted by Powhatan Road and the existing railroad easement respectively. Expansion to the west is restricted by existing facility already integral to personnel flow. Due to these geographic restrictions and our need to integrate the proposed facilities into our current process, expansion to the north is the clear alternative. Proposed Impacts The proposed facilities expansion consists of approximately 117,000 square feet of building space, which is necessary to accommodate increased global insulin production demands. In order to construct the proposed expansion impacts to the riparian buffer and stream channel were required. The proposed impacts due to the access road/loading dock construction include 111 linear feet of perennial channel, and 0.3 acre (12,933 ft2) of riparian buffer. The proposed impacts due to facilities construction include 118 linear feet of.perennial channel, and 0.42 acre (17,259 ft2) of riparian buffer. The total impacts resulting from the proposed facilities expansion include 229 linear feet of perennial channel and 0.72 acre (30,191 ff) of riparian buffer. There will be no impact to wetlands on-site. October 13, 2004 S&EC Project #6324.W1 Page 3 of 3 Impervious Surface/Stormwater The existing impervious surface area fro the site is 15%. Proposed impervious surface area (i.e. existing + proposed) totals 31 %. A Stormwater plan was submitted with the buffer variance request and can be supplied again if necessary. A copy of the maintenance agreement for the stormwater pond is also attached. ` Mitigation The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and may require compensatory mitigation to offset unavoidable losses. During the site meeting with Mr. Kevin Yates, it was determined that the stream with the proposed impacts is perennial and will require mitigation at a 1:1 ratio. The NC-EEP agreed to accept payment for the required stream and buffer mitigation. A copy of the EEP acceptance letter is attached. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Describe the overall project in detail, including the type of equipment to be used: The project is the expansion of the existing acility and will impact one perennial stream and its Liparian buffers due to building and road construction. The construction will employ typical grading and excavating equipment 11. Explain the purpose of the proposed work: The proposed facilities expansion consists of approximately 117,000 square feet of building space which is necessary to accommodate increased global insulin production demands IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. The site was owned by another company at the time of construction and no prior permitting information is available at this time (see attached variance request letter). After S&EC completed a detailed wetland delineation a site meeting was held with Mr. Kevin Yates of the USACE on September of 2004 at. which time it was determined that the stream with proposed impacts is perennial and would require mitigation at a 1:1 ratio. It was also determined that the existing stormwater pond on-site is not jurisdictional and will therefore continue to be used for stormwater. V. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. No future 401/404 permits are anticipated on this site at this time. VI. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. The applicant must also provide justification for these impacts in Section VII below. All proposed impacts, permanent and temporary, must be listed herein, and must be clearly identifiable on an accompanying site Page 3 of 8 plan. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a delineation map, whether or not impacts are proposed to these systems. Wetland and stream evaluation and delineation forms should be included as appropriate. Photographs may be included at the applicant's discretion. If this proposed impact is strictly for wetland or stream mitigation, list and describe the impact in Section VIII below. If additional space is needed for listing or description, please attach a separate sheet. 1. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Page 5 of 8 USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when' necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. The NC-EEP has agreed to accept payment and responsibility for the required buffer mitigation and the required 1:1 stream mitigation. Please see the attached EEP letter. 2. Mitigation may also be made, by payment into the North Carolina Wetlands Restoration Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at (919) 733-5208 to determine availability and to request written approval of mitigation prior to submittal of a PCN. For additional information regarding the application process for the NCWRP, check the NCWRP website at htip://h2o.enr.state.nc.us/wW/index.htm. As per Patrick Smith's (S&EQ office meeting with Bob Zarzecki, all proposed impervious surface area will meet current stormwater standards. Stormwater devices will be added as much as possible to treat run-off from the existing acility. Current site conditions include 15% impervious surface area. Proposed site conditions including the existing acility will total 31 % impervious surface area. XII. Sewage Disposal (required by DWQ) Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility. County: Johnston The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept payment for stream and buffer impacts associated with the subject project. Please note that the decision by the NCEEP to accept the mitigation requirements of this project does not assure that this payment will be approved by the U.S. Army Corps of Engineers and the N.C. Division of Water Quality Wetlands/401 Unit. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP for impacts associated with this project is appropriate. This acceptance is valid for six months from the date of this letter. H we have not received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will expire. It is the applicant's responsibility to forward copies of the 404 Permit/401 Certification to the NC Ecosystem Enhancement Program in order for an invoice to be generated. Based on the information supplied by you in a letter dated September 9, 2004 the stream and buffer restoration that is necessary to satisfy the compensatory mitigation requirements for this project is summarized in the following table. The maximum amount of mitigation that the NCEEP will accept for this project is also indicated in this table.
