The Division of Water Resources (DWR) has performed a review of a 401 Water Quality Certification
application received on June 19, 2015 for the above referenced project. The Division has determined that your
application is incomplete and cannot be processed. The application is on -hold until all of the following
information is received:
1. Avoidance and Minimization: Please provide more details regarding avoidance and
minimization of the W2 and S2 impacts for this project. [15A NCAC 02H .0506(f) and (g)].
This office believes that the W2 wetland impact can be moved to the northwest along the
ephemeral channel to avoid and minimize the wetland impact. Please revise the °plans to
minimize the impact or provide a detailed explanation of why this plan for the activity cannot be
practically accomplished, reduced or reconfigured to avoid impacts to the existing wetland.
This office believes that the S2 stream impact (113 linear feet) can be reconfigured to minimize
the stream impact. Please explain why a smaller impact crossing (e.g. 20 linear feet) cannot be
installed to provide cattle and farm equipment access to the pastures on both sides of the existing
stream. Please revise the plans to minimize the impact or provide a detailed explanation of why
this plan for the activity cannot be practically accomplished, reduced or reconfigured to better
minimize the disturbance and impacts to the existing stream.
2. Per Condition #13 of GC3890, please provide details on how you are going to maintain the
physical integrity and provisions for aquatic life passage for the stream above and below the
proposed culverts. Please provide a detailed plan, profile view, and cross - section of all proposed
culverts including the proposed pipe slope and burial depths. [15A NCAC 02H .0502(b)]
3. Please provide a typical detail for the proposed pond dam including slopes, elevations, and an
outlet detail.

4. Please provide additional details on the proposed permanent and temporary seed mixes for the
impacted wetland and stream areas.
Per Condition #6 of GC 3890, all work must be done "in the dry ". Therefore, dewatering
methods will be necessary to temporarily dewater the stream channel during pipe installation.
Please provide a construction sequence that details the method of dewatering to be utilized at the
site and the sequence of construction events to be followed to ensure compliance with this
condition. [15A NCAC 02H .0502(b)(3)]
If all of the requested information is not received in writing by the response due date, the DWR will be unable
to approve the application and it will be returned. The return of this project will necessitate reapplication to the
DWR for approval, including a complete application package and the appropriate fee.
