The DWR will place review of the 401 application 'on -hold' pending receipt of the revised plans. Please remember due to a federal rule promulgated in 2020, DWR also has a federal clock that requires DWR to act on a 401 certification request within 120 days and the federal clock that applies to DWR does not toll or restart for any reason, including additional information requests. In this case, DWR has is required to act by 8/4/2023. Per 40 CFR 121.6, the applicant can request that the USACE extend the federal clock for DWR action on the 401 application. It may be advisable to make this request to the USACE to allow both the state and federal agencies ample time to review the revised application materials. Good afternoon Holley, thanks for discussing the various time lines you have with the decision making process for our permit just now. As discussed, we plan to abandon the upland basin concept and modify the plans to reflect a boat ramp and single family lots will take the place of portions of the previously proposed upland basin. With that proposed change can you extend our time to make those changes and coordinate with the other agencies to implement those.
