We submitted a permit application (non -notifying for DWR) for the replacement of Bridge no. 241 on Old Salisbury Road on July 5, 2023. Prior to permitting, we had conversations with the USACE (see email below) regarding ROW impacts to the adjacent Friedberg Marsh Mitigation site. The impacts were located entirely in uplands (no streams and wetlands). The USACE had stated that they had no objections to the encroachment on the site. I don't recall us coordinating with you (or why we didn't). Can you let me know if you have any concerns? This information was included in the ePCN, but I wanted to make sure that you had a chance to comment since a written authorization is not required. As a note, the project qualified for a non -reporting NWs from the USACE; however, that changes with the proposed listing of the tricolored bat as endangered. Let me know if you need to discuss. Amy: On 2/8/2022, the US Army Corps of Engineers, Wilmington District received your e-mail notification with plans and impact summary (revised 2/9/20220 for Project BP9.R009, the proposed replacement of Bridge 241 on SR 3011, Old Salisbury Road at South Fork Muddy Creek in Forsyth County, North Carolina. Your notification indicated that you will impact a total of 263 linear feet of tributaries (208 linear feet of bank stabilization and 55 linear feet of temporay impact for dewatering and water line relocation) . Based on the information provided in your application, your work is authorized by Nationwide Permit (NWP) 13 Bank stabilization, and NWP 58 Utility line activiies for water, and does not require a pre -construction notification (PCN), provided it is accomplished in strict accordance with the attached conditions and your submitted description. Any violation of the attached conditions or deviation from your submitted description may subject the permittee to a stop work order, a restoration order and/or appropriate legal action. Attached are copies of the NWPs 13 and 58, and the applicable permit conditions. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the activity is completed within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case -by -case basis to modify, suspend or revoke the authorization. Note: We also have evaluated your proposed project's encroachment on the NCDOT Friedburg mitigation site (2,173 square feet (sf) of fill in upland, 3,077 sf of hand clearing in upland, and 4,132 sf of water line construction in South Fork Muddy Creek). We have determined that the encroachment will have minimal impact on the functioning of the mitigation site, and no additional mitigation or further action is required. This response to your notification does not relieve the permittee of the responsibility to obtain any other required Federal, State or local approvals/permits. If an individual water quality certification is required from the North Carolina Division of Water Resources, the conditions of the certification are conditions of the NWP, and you are not authorized to start work in waters until a 401 is issued.
