William,
I just wanted to follow up our conversation yesterday and concur on the determination that placement of the H-piles in
the areas currently permitted for temporary impacts for this project will not require a permit
reauthorization/modification. As we discussed yesterday, I think that having a plan to remove the trestle before
anticipated high flow event may prevent some loss of the trestle and/or damage within you construction site from
accumulating debris and scour. Also, the proposed measures to minimize tracking of soil across the trestle and
containment of soil on the trestle (preventing entry into the stream) is a good BMP for this temporary structure. Finally,
keep the duration of the trestle placement across the stream to the minimum time necessary to get the required
construction steps completed. Please let me know if you have any questions. Thanks.

Below is the response I sent to DOT engineer and the sedimentation erosion control inspector.
Michael,
I just received responses from USACE and NCDWR. Both permit agencies are ok with the trestle request as shown on
the drawing you submitted. Since the H-piles are located within a permitted area for temporary impacts then permit
modification is not necessary.
The USACE does not want the trestle in place during high water/flow events; therefore, if such an event is expected then
the trestle will need to be removed until the water levels recede. The deck will need to have containment measures as
discussed during the site visit.

We are within the construction ROW and the H-piles will be within the dewatered area between the
impervious dike and the streambank. The impervious dike will already be in place for the removal of the
old bents and the streambank stabilization activities. The requested trestle will span the rest of the
creek.

How about in the morning at 9:00? Otherwise, if impacts are within construction right of way (which
they appear to be) your covered as far as state is concerned.

The contractor for B-5808 (USACE ACTID: SAW-2022-00366; NCDWR 20210446) is
asking about a possible work trestle across the creek. Only temporary impacts from H-
piles within the dewatered areas adjacent to the streambanks (see attached).
