Adherence to these instructions and checking the provided boxes will help produce a quicker review time and reduce the amount of additional information requested. Failure to submit all of the required items will lead to additional processing and review time for the permit application. Unless otherwise noted, the Applicant shall submit one original and two conies of the application and supporting documentation For more information, visit the Water Quality Permitting Section's Non -Discharge Permitting Unit General — This application is for treatment, storage, transport, and/or land application of Class B residuals (may include residuals that are generated from a water treatment plant or other type facilities) on the proposed or currently approved land application site(s) under 15A NCAC 02T .1100. Unless otherwise noted, the Applicant shall submit one original and two copies of the application and supporting documentation listed below. A. Residuals Land Application Program (FORM: RLAP 06-16) Application: (All Application Packages): Submit the completed and appropriately executed Residuals Land Application Program (FORM: RLAP 06-16) form. Please do not make any unauthorized content changes to this form. If necessary for clarity or due to space restrictions, attachments to the application may be made, as long as the attachments are numbered to correspond to the section and item to which they refer. ❑ The Applicant's Certification on Page 5 of this form shall be signed in accordance with 15A NCAC 02T .0106(b). An alternate person may be designated as the signing official if a delegation letter is provided from a person who meets the criteria in 15A NCAC 02T .0106(b). ❑ If this project is for a modification of an existing permit, submit one copy of the existing permit. ❑ Please submit this application form at least 180 days prior to the expiration date on the existing permit, or 90 days prior to operation of proposed facility(ies) for application packages involving new or changes to treatment and storage units. Cover Letter (All Application Packages) ❑ List all items included in the application package, as well as a brief description of the requested permitting action. D. Environmental Assessments (Maybe Required —See 15A NCAC 1C .0300) ❑ Submit a copy of the Findings of No Significant Impact (FONSI) or Environmental Impact Statement (EIS). Also, include information on any mitigating factor(s) from the Environmental Assessment (EA) that impact the construction of the residuals treatment and storage facilities. An EA may also be required for private systems if any public funds and/or lands are used for the construction of the subject facilities. INSTRUCTIONS FOR FORM: RLAP 06-16 Page 1 of 3 E. Operation and Maintenance Plan (New and Renewal Application Packages) ❑ For Modification Application, if there are any changes to the existing plan, submit an updated O&M plan. ❑ Submit the O&M Plan in accordance with 15A NCAC 02T . 1110 and include at a minimum: ❑ Operational functions; describe the operation of the program to show what operations are necessary for the program to function and by whom the functions are to be conducted. ❑ Maintenance schedules; may include equipment calibration, maintenance of signs, etc. ❑ Safety measures; may include safety training program, manuals, signs, etc. ❑ Spill response plan; including control, containment, remediation, emergency contact information, etc. ❑ Inspection plan including the following information; ❑ Names and titles of personnel responsible for conducting the inspections. ❑ Frequency and location of inspections, including those to be conducted by the ORC, and procedures to assure that the selected location(s) and inspection frequency are representative of the residuals management program. ❑ Detailed description of inspection procedures including record keeping and actions to be taken by the inspector in the event that noncompliance is observed. ❑ Sampling and monitoring plan including the following information; ❑ Names and titles of personnel responsible for conducting the sampling and monitoring. ❑ Detailed description of monitoring procedures including parameters to be monitored. ❑ Sampling frequency and procedures to assure that representative samples are being collected. Fluctuation in temperature, flow, and other operating conditions can affect the quality of the residuals gathered during a particular sampling event. The sampling plan shall account for any foreseen fluctuations in residuals quality and indicate the most limiting times for residuals to meet pathogen and vector attraction reduction requirements (e.g. facilities that land apply multiple times per year but have an annual sampling frequency, may need to sample during winter months when pathogen reduction is most likely to be negatively affected by cold temperatures. THE FOLLOWING ADDITIONAL ITEMS (G to M) ARE REQUIRED FOR DEDICATED PROGRAM ONLY. F. Program Determination ❑ Dedicated residuals land application programs are ones in which land application sites meet the criteria in 15A NCAC 02T .110202). Specifically, a residuals land application program is designated as dedicated if any of the following are applicable: ❑ Any land application site certified for the residuals land application program that receives residuals at rates or frequencies greater than agronomic rates. ❑ Any land application site certified for the residuals land application program that is used primarily for residuals disposal, and agricultural crop production is of secondary importance. ❑ Any land application site certified for the residuals land application program that receives residuals through fixed irrigation facilities or irrigation facilities fed through a feed supply system. ❑ Please contact the Non -Discharge Permitting Unit if you need any assistance in determining whether your residuals program falls under the dedicated program definitions. G. Program Information Provide an explanation of why a dedicated system is required instead of a conventional non -dedicated system. ❑ Provide an explanation of the dedicated system and its operation. H. Detailed Site Maps (All New or Modification Application Packages) ❑ Submit three (3) sets of standard size plans and two (2) sets of I I" by 17" plans (electronic format is acceptable - Adobe PDF only). For Modifications, submit plans specific to the modification(s) only. ❑ Plans must include the following minimum items: ❑ A general location map, a vicinity map and a topographic map with contours not exceeding 10 feet or 25% of the total site relief and showing all facility related structures and fences within the land application area. ❑ The location of all wells (including usage and construction details if available), streams (ephemeral, intermittent, and perennial), springs, lakes, ponds, and other surface drainage features within 500 feet of the land application site(s). ❑ Delineation of the review and compliance boundaries ❑ Setbacks as required by 15A NCAC 02T .1108 ❑ Site property boundaries within 500 feet of all waste treatment, storage, and disposal site(s). ❑ A map showing the entire irrigation area with an overlay of the suitable irrigation area depicted by the soil scientist's evaluation. The irrigation plans shall show each nozzle/emitter and wetted area (when applicable). Clearly label spray irrigation zones as they will be operated. ❑ Plans must depict a completed design and not be labeled with preliminary phrases (e.g., FOR REVIEW ONLY, NOT FOR CONSTRUCTION, etc.) that indicate that they are anything other than final plans. Project Evaluation and Receiver Site Management Plan (All New Application Packages or Modifications that include new sites) ❑ Submit a project evaluation and a receiver site management plan (if applicable) with recommendations concerning cover crops and their ability to accept the proposed application rates. Signature: Date: 6-29-2023 FORM: RLAP 06-16 Page 5 of 5 Operation and Maintenance Plan City of Marion, WWTP Permit No. WQ0037135 In accordance with the requirements as issued by the North Carolina Department of Environmental Quality using NCGS 143-215.1 and 143-215.3(a) based on 15A NCAC 02T .110, the City of Marion and U.S Biosolids, Inc. are implementing this Operation and Maintenance Plan. The Land Application of Non -Dedicated Class B Residuals from the City of Marion WWTP will be conducted from the Wastewater Treatment facility, located at 3892 Highway 226 South Marion, NC 28752. Residuals will be removed and given away to farmers to be used as a soil amendment. The residuals will be removed on as needed bases as fluctuation in the output of the plant will vary with changing economic conditions. The day-to-day operation of the running of the Wastewater Treatment will be conducted by Tim Horton, Wastewater Superintendent of the City of Marion WWTP or his/her designee. The operations of the land application program will be conducted by Zach Key of U.S Biosolids, Inc. or his/her designee. Land application of residuals will be determined once enough residuals have been produced from processing of biological residuals to fill the 700,000-gallon residual digester. The land application event is initiated by the Marion Wastewater Treatment plant contacting U.S. Biosolids, Inc. U.S. Biosolids, Inc. will contact the farmers in listed in the permit to arrange for a land application event to occur. This my take up to 45 days to arrange due to crop and animal rotations and weather conditions, so a land application event must be planned enough in advance, so enough freeboard is maintained in the residual digester. Prior to land applying these residuals to permitted sites, the following sampling conditions must be met (as is outlined in greater detail in the sampling plan attached to this Operation and Maintenance Plan). Toxicity Characteristics Leaching Procedure (TCLP) will be conducted once per year, if a land application event takes place. A metals and nutrients analysis, pathogen and vector attraction, and soil analysis will be conducted annually if a land application event takes place. These samples will be collected by Tim Horton or his/her designee and transported to an approved lab the same day the samples are taken, as in accordance with 15A NCAC 02B .0505. The samples must be taken in a matter to ensure a representative sample of the residuals has been taken. An inspection will be conducted daily while a land application event is taking place. All on road equipment is check as per DOT regulations for any safety or mechanical hazards or issues. 6. All equipment is secured at the end of each working day to prevent any tampering or unauthorized use. 7. Enough freeboard is maintained in the residual digesters so to prevent overflowing. This can be accomplished by maintaining the levels of residuals to an acceptable level by planning adequate land application events to keep up with residuals production. City of Marion, WWTP Permit No. WQ0037135 SAMPLING PLAN Annually, if a land application event occurs, grab samples are collected from the digester. Samples from the digester will be combined to form individual grab samples to be sent to a laboratory for analysis. These individual grab samples are collected and tested for fecal coliform analysis, vector attraction reduction, nutrient analysis, and a TCLP test. These tests will be taken by the Tim Horton from City of Marion or his/her designee. All samples apart from the vector attraction sample will be taken to a state certified laboratory. The vector attraction sample will be analyzed in house at the City of Marion, W WTP. The vector attraction reduction will first be attempted to be achieved using option 4 [503.33(b)(1)]; Specific Oxygen uptake know as a SOUR test. This sample will be taken from the digester. Fecal Coliform is gathered in seven (7) individual samples and tested to meet the requirements of [503.32(b)(2)]. This requirement is for the geometric mean fecal coliform density of the samples be less than two million (2,000,000) MPN per gram. These samples will be placed in 250ml containers and placed on ice, in a cooler for transport to the laboratory before 1600 hours (4pm) the same day the samples are obtained. Annually, if land application occurs, a composite residual sample will be analyzed, prior to a land application event for: Cadmium, Copper, Lead, Mercury, Molybdenum, Nickel, Selenium, Zinc, Aluminum, Ammonia Nitrogen, Calcium, Nitrate Nitrogen, Magnesium, % total Solids, pH, Phosphorus, Potassium, TKN, Sodium. '['he Permittee has provided the landowner or his representative with information and data concerning the residuals land application program, including an analysis of constituents of the residuals, residuals application methods, schedules for typical cropping patterns. a description of the equipment used by the Permittee. 7. The Permittee will provide the landowner or his representative kvith a copy of the residuals permit prior to commencement of any residuals land application event and a copy of the results of each soil analysis. 8. If the soil pH of the land application site(s) is not maintained at 6.0 or greater, sufficient amounts of lime shall be applied to achieve a final soil pi I of at least 6.0, unless an agronomist provides information indicating that the pH of the soil, residuals and lime mixture is suitable for the specified crop. 9. The landowner or his representative and the Permittee will agree on residuals application rates and schedules based on crop patterns, results of soil samples. and the permitted application limits. 10. The landowner or his representative will provide the Permittee with information regarding the amount and analysis ofother sources of nutrients (e.g.. fertilizer. unregulated animal waste, etc.) that have been applied to the land application site(s). 11. The landowner or his representative will inform the Permittee of any revisions or modifications to the intended use and cropping patterns for or the land application sites) prior to each planting season to enable the Permittee to amend this Agreement and schedule residuals land application events at appropriate periods. 12. Specific residuals land application area boundaries shall be clearly marked on the land application site(s) by the Permittee, the landowner, or his representative prior to and during a residuals land application event. 13. The landowner or his representative hereby authorizes the Permittee, local officials, and State officials or their representatives to, enter and inspect any property, premises. or place on or related to the land application site(s) at any reasonable time for the purpose of determining compliance with the pert -nit: establish monitoring facilities on or near the land application site(s) as required by the permit: copy any records that must be kept under the terms and conditions of the permit: take necessary leachate. Surface water, groundwater, or soil samples during the term of. and 12 months after termination of, this Agreement. If. RESTRICTIONS: I. Appropriate measures must be taken by the Permittee and/or the landowner or his representative to control public access to the land application site(s) during active use and for the 12-month period following a residuals land application event. Such controls may include the posting of signs that indicate the activities being conducted at the land application site(s). 2. Animals shall not be grazed on the land application site(s) for a 30-day period following a residuals land application event. Land application sites that are to be used for grazing shall have fencing that will be used to prevent access during these periods after such residuals land application events. 3. Food crops, feed crops. and fiber crops shall not be harvested for a 30-day period following a residuals land application event. 4. Food crops with harvested parts that touch the residuals/soil mixture and are totally above the land surface shall not be harvested for a I 4-month period following a residuals land application event. 5. Food crops with harvested parts below the surface of the land shall not be harvested for a 20-month period following a residuals land application event when the residuals remain on the land surface for four months or longer prior to incorporation into the soil. 6. Food crops with harvested parts below the surface of the land shall not be harvested for a 38-month period following a residuals land application event when the residuals remain on the land surface for less than lour months prior to incorporation into the soil. 7. The Permittee will provide the landowner or his representative with a copy ofthe residuals permit prior to commencement of any residuals land application event and a copy ofthe results of each soil analysis. 8. If the soil pFl of the land application site(s) is not maintained at 6.0 or greater, sufficient amounts of lime shall he applied to achieve a final soil pli of at least 6.0. unless an agronomist provides information indicating that the pl I of the soil, residuals and lime mixture is suitable for the specified crop. 9. Specific residuals land application area boundaries shall be clearly marked on the land application site(s) by the Permittee, the landowner, or his representative prior to and during a residuals land application event. 13. The landowner or his representative hereby authorizes the Permitlee. local officials. and State officials or their representatives to; enter and inspect any property. premises. or place on or related to the land application sites) at any reasonable time for the purpose of determining compliance with the permit: establish monitoring facilities on or near the land application site(s) as required by the permit; copy any records that must be kept under the terms and conditions of the permit: take necessary Ieachate. surface water, groundwater, or soil samples during the term of. and 12 months after termination of. this Agreement. IL RESTRICTIONS: I. Appropriate measures must he taken by the Permittee and/or the landowner or his representative to control public access to the land application site(s) during active use and for the 12-month period following a residuals land application event. Such controls may include the posting of signs that indicate the activities being conducted at the land application site(s). 2. Animals shall not be grazed on the land application site(s) for a 30-day period following a residuals land application event. Land application sites that are to be used for grazing shall have fencing that will be used to prevent access during these periods after such residuals land application events. 3. Food crops. feed crops. and fiber crops shall not be harvested fora 30-day period following a residuals land application event. 4. Food crops %%ith harvested parts that touch the residuals/soil mixture and are totally above the land surface shall not be harvested for a 14-month period following a residuals land application event. 5. Food crops with harvested parts below the surface ofthe land shall not be harvested for a 20-month period following a residuals land application event when the residuals remain on the land surface for four months or longer prior to incorporation into the soil. 6. Box 146 RONDA, NC 28670 3 36-777-6909 SITE AND INVESTIGATION SUMMARY AND OVERALL RECOMMENDATIONS The purpose of this evaluation was to review the proposed site and soils for suitability for residuals application as required by 15 A NCAC 02T and the subsequent site evaluation policies found in the Soil Scientist Evaluation Policy document from September, 2008. This report will document the site evaluation details and includes all required reporting information therein. Representative soil fertility and heavy metal samples were collected and these samples were analyzed for the required fertility analysis and baseline heavy metal content. The site is located at 824 Grace Howard Rd in Roaring River, NC. For the purposes of permitting, the farm is divided into 2 fields. Attached map 1 shows the general location of the site, map 2 shows the location of the fields within the farm, and map 3 shows the general topography of the site. The overall tracts total 35.89 acres, and the fields proposed for biosolids application have acreages as indicated in Table 1. The site is in the watersheds of Little Bugaboo Creek, part of the Yadkin PeeDee River Basin. For specifics for each field, see Table 1 below. As the site is proposed for surface application of residuals, the field portions with slopes exceeding 10 percent have been indicated on the Site Investigation Map (map 5) attached herein. The slopes in the useable portion of the fields range from 3 to 10 percent. Depth to rock or water table was over 4 feet in all soil observations, although one quartz outcrop was observed in field 2. Soil borings were completed in both fields and the location of these borings is found on the attached Site Investigation Map (map 5). These borings confirmed the USDA Natural Resources Conservation Service soil map of the site in both fields. Because the soil evaluation closely confirmed the soil mapping by the National Cooperative Soil Survey, with only inclusions that are within the design of the designated map units, no distinct map unit lines have been mapped on the Site Investigation Map- all areas shown are the same soil type and consistent with the soil survey. Amore detailed discussion of the soils on the site can be found in the "Soil Investigation Results" section below. Representative soil samples of each field were taken using a stainless steel core sampler to a depth of 6". Samples were taken randomly over the entire field. The results of the soil fertility tests (attachments 4 and 5) and of the heavy metal analysis (attachments 6 and 7) support the use of this site for residuals application. With the exception of required setbacks for homes, wells, rights -of -way, surface waters, drainageways and/or property lines, and slope areas exceeding 10 percent that are buffered out, the remainder of these fields are recommended for class 8 residuals application,. Setbacks to all required features must be flagged at the time of residuals application. The slope areas exceeding 10 percent will also need to be flagged out at the time of residuals application. SOIL INVESTIGATION RESULTS Field 1 (Site Investigation Map 5) Soils in this fields are mapped as FcB2 Fairview sandy clay loam, 2 to 8 percent slopes, moderately eroded, FcC2, Fairview sandy clay loam, 8 to 15 percent slopes, moderately eroded and as FaD, Fairview sandy loam, 15 to 25 percent slopes on the USDA NRCS soil survey (see map 4). Fairview soils are well - drained, with a clayey subsoil and soil depth exceeding 20 inches to parent material and a depth greater than 60" to lithic or paralithic contact. The clayey Bt is less than 30" thick. Inclusions observed in this field included Clifford soils, which have a thicker clay subsoil. See attached Official Series Description for Fairview and Clifford soils (attachmentl and 2). The taxonomic classification of the observed soils are as follows: Fairview (taxonomic class: Fine, kaolinitic, mesic Typic Kanhapludultsy, and Clifford (taxonomic class: Fine, kaolinitic, mesic Typic Kanhapludults ). Soils were moderately eroded with a clay loam surface. The inclusions observed are commonly found in Fairview soil map units and have similar use and management. Taken as a whole, these borings confirmed the accuracy of the USDA NRSC soil survey in these fields, with a slightly different surface texture. Field 1 is planted in mixed fescue pasture/hay, in good condition. 5 borings were observed in this field. Slopes were 3-15% Field 2 (Site Investigation Map 5) Soils in this field are mapped as FcC2, Fairview sandy clay loam, 8 to 15 percent slopes, moderately eroded and as FaD, Fairview sandy loam, 15 to 25 percent slopes on the USDA NRCS soil survey (see map 4). Crop health is good. Overall, the soil tests show normal agronomic management and do not indicate any parameters that pose a concern for residuals application. Liming and nutrients: Addition of residuals must be monitored such that the known application rates of nitrogen, phosphate, potash, and lime equivalent are taken into account with respect to the soil test recommendations, or the RYE limit as given from the nutrient management tables. The permanent hay/pasture should supply adequate erosion control for those fields; however, judgment must be applied when applying liquid biosolids to fields where slopes exceed 6 percent as runoff may occur. The NCDA&CS Agronomic Section's soil test results are applicable for all nutrients, and lime, EXCEPT NITROGEN. 2T rules require the use of nutrient management Realistic Yield Expectaion (RYE) guidance from North Carolina State University (NCSU) when defining application rates of residuals. Soils on the site are distributed as indicated in table 2 (below). Where no one soil predominates, the more limiting soil is used. No lime application is recommended for either field. If the applied wastewater residuals are handled in a manner that would render them as a liming source, then the residuals should be tested for their liming equivalency (also called calcium carbonate equivalency) to ensure that soils are maintained at an optimum pH. Phosphate index (P-1) in all fields is high and no additional P is required. Potash Index (K-1) is high in field 1 with no additional K is required. In field 2, 60 Ibs/acre are recommended. One special concern on these fields is the high zinc (Zn-1) and copper indices (Cu-1). Zinc indices ranged from 478 to 574 and Copper indices range from 757 to 800, with any value over 100 considered "excessive". According to the NC Cooperative Extension Soil Facts article on "Poultry Litter as a Fertilizer Source" (https://content.ces.ncsu.edu/poultry-litter-as-a-fertilizer-source, accessed 4/9/2023), at zinc or copper indices of 2000 or higher, "alternative application areas should be considered", and at indices of 3000 there should be no further applications of copper or zinc of any kind. Based on this, from an APRIL 10, 2023 824 GRACE HOWARD RD, ROARING RIVER, WILKES COUNTY NC P A G E 15 agronomic perspective, these sites are still safe for application of materials containing copper or zinc. In addition, heavy metal testing indicated that these fields are well below the limits set for biosoIids application with regards to copper and zinc (see below) No secondary or micronutrients are deficient and no amendments of such are recommended. With adequate erosion control as currently exists and with ongoing maintenance of ground cover, P and other nutrient losses should not be a concern. Sodium and ESP: The sodium levels for all fields are very low at 0.1 milliequivalents/cm3. The exchangeable sodium percentage (ESP) is found on the soil test reports as % of cation exchange capacity. ESP is at 1% for both fields and will not be limiting for residuals application. ESP is a parameter that should be calculated annually as residuals are applied to help with sodium monitoring. Metals: Soils were evaluated for regulated metals as required by 2T rules. Samples were submitted to Waypoint Analytical in Charlotte, NC far heavy metal analysis. Chain of custody was documented. See table 4 for summary of results. The results of the heavy metal testing shows that generally this site is nowhere near the cumulative pollutant loading rate (CPLR) for most of the heavy metals tested. The only exception to this is arsenic, which is at about 15-20% of the CPLR. Arsenic levels in the soil and residuals being applied will need to be closely monitored to remain below the limit of 41 kg/ha. It should be additionally noted that Mercury was tested 3-4 days outside of the 28 day testing window. However, results were so low, below detection limit for this analytical method and less than .03% of CPLR that it seems unlikely that results would have been materially different (ie, significantly close to CPLR) within the testing window. A common issue in this area is levels of Zinc and Copper due to application of poultry manure. On this site levels of zinc and copper are at high levels from an agronomic perspective (see above) but are not anywhere near EPA maximum CPLR. Taxonomic class: Fine, mixed, semiactive, thermic Ultic Hapludalfs. No seasonal high water table present to a depth of 48"+ at the boring location. Both Skyuka and Chewacla soils were encountered in the field's southern half. Chewacla taxonomic class: Fine -loamy, mixed, active, thermic Fluvaquentic Dystrudepts. Center of field is mildly concave and a seasonal high water table (SHWT) was encountered at 22" and 23". A dozen shallow borings were dug to a depth of 12" all along the creek side of the field, approximately 50-75' away from the creek to check for SHWT; none was encountered.
