Application Review
AP Peabody & Gregson LP is seeking an individual discharge permit for wastewater from a groundwater
remediation system. This is for a commercial redevelopment project in downtown Durham which requires
the removal of groundwater to lower the water table. The groundwater will be collected by sump and pump,
treated via a granular activated carbon (GAC) filter, and subsequently discharged into a storm drain which
eventually flows into an unnamed tributary to Ellerbe Creek, which is considered a zero -flow stream. The
estimated discharge flow is 455 GPD.
This property was previously the location of a dry-cleaning operation for 62 years, and the groundwater is
impacted by chlorinated solvents. The NC DEQ Dry -Cleaning Solvent Cleanup Act (DSCA) program has
listed this property as Open Incident No. DC320026.
Proposed Treatment System
Proposed treatment components for the groundwater remediation system include the following:
• Sump pump
• Wet well
• Bag filter
• Two (2) 55-gallon granulated activated carbon filters (GAC), in series
• Piping to outfall
Permitting Summary
As this is for a NEW discharge, the following permitting decisions were made:
• Included Section A. (1) specifying all effluent limits and monitoring requirements, as detailed in the
table below.

• Included Section A. (2) detailing the requirements for WET testing.
• Included Section A. (3) re -opener clause to address 1,4-dioxane after permit issuance.
• Included Section A. (4) requiring additional monitoring for VOCs and Semi-VOCs.
• Included Section A. (5) requiring the electronic reporting of Discharge Monitoring Reports (DMRs)
to meet current federal requirements.
The following effluent limits and monitoring requirements were included in this permit in Section A. (1):
Flow monitoring frequency is Instantaneous as the proposed discharge is less than 10,000 gpd and
is for a groundwater remediation, per the 2005 Flow Monitoring Memo.
EPA Methods 624.1 and 625.1 monitoring is required as VOCs and Semi-VOCs are a concern
based on the detections from initial sampling done at the facility site.
Monitoring for 1,4-dioxane is required based on the fact that the site of this facility is impacted by
chlorinated solvents. A re -opener clause is added in Section A. (3).

included in the draft permit. An ATC is not required for this type of facility per NC Session Law
2011-394.

• Based on comments received from the Aquatic Toxicity Branch, footnote #5 for WET testing has

Whole Effluent Toxicity (WET) Testing
For dewatering and groundwater remediation systems that are permanent and operating for multiple years,
it is recommended that the required WET testing be performed Quarterly as an Acute, 24-hour static test
(monitoring only) using Fathead Minnow (Pimephales promelas) [eDMR code TGE6C]. As this facility
is proposing to discharge to a stormwater drain (zero -flow), the effluent concentration is 90%.
Reasonable Potential Analysis
A reasonable potential analysis (RPA) was not performed because there is very limit sampling data
collected sporadically from the untreated groundwater at the site.
Alternatives Summary (EAA):
AP Peabody & Gregson LP is working on a commercial redevelopment project in downtown Durham
which requires the removal of groundwater at the property to lower the water table. The groundwater has
been impacted by chlorinated solvents due to the location being previously used as a dry-cleaner. As the
property is in a dense urban area, the applicant is seeking to build a groundwater remediation system and
discharge treated wastewater into the City of Durham's storm sewer drain.
AP Peabody & Gregson LP evaluated multiple alternatives which have been summarized below. They have
concluded that a discharge to surface waters is the most feasible option. After a thorough review of the
EAA documentation and discussion with the EAA review team, the Division agrees with the applicant's
conclusion that a discharge to surface waters is the most feasible option.
Connection to sewer system
o City of Durham's POTW stated that discharge to their sanitary sewer system is not a long-
term solution and did not provide approval for discharge to Durham's wastewater treatment
system.
Land Application (Non -Discharge)
o Land application via spray irrigation or drip irrigation was determined to be unfeasible due
to the location of the property in a dense urban environment.
o Subsurface infiltration galleries need to be hydrologically downgradient. The applicant
states that the direction of groundwater at the location of the property should flow north-
northwest. The building footprint covers the full lot in the area which is hydrologically
downgradient, therefore additional property would need to be acquired for a suitable
infiltration gallery. The applicant identified multiple lots located downgradient and
provided a cost summary based on one of the cheapest lots. The total present value cost is
$722,329.
• Water Reuse
o Wastewater reuse was determined to be unfeasible due to the location of the property in a
dense urban environment. Reuse water in a residential setting is used for toilet flushing.
Due to the variable discharge rate, a stable water source would be needed to combine with
the treated wastewater. Potable water would be the only stable water source and is unable
to be combined with reclaimed water without Department approval (15A NCAC 02U .0403
(0)•

o The applicant has been pumping and hauling the groundwater since Sept 2021. The average
annual cost of pump & haul is estimated to be $72,500, with a total present value cost (20-
year estimation) to be $854,464.

Discharge to Surface Waters
o The applicant is proposing a discharge to the City of Durham's storm sewer system. VOCs
are of primary concern based on lab analysis of the groundwater. The groundwater will be
treated using a bag filtration and carbon adsorption system. The proposed discharge will
travel through the City's storm sewer system and eventually discharge to an unnamed
tributary to Ellerbe Creek (stream index 27-5-(0.7)), a class WS-IV; NSW waterbody. The
total present value cost of this alternative is $130,539.00.
o Air stripping is not being considered as a treatment option due to the requirement of an
enclosed structure and the possibility of discharging contaminated vapors near occupied
areas.
• Local Government Review
o City of Durham indicated that there are zoning/subdivision ordinances in effect and that the
proposed facility is consistent with these ordinances. (Attachment D in EAA)

Hi Sydney,
This will be a permanent/foreseeable future solution. The discharge isn't quite continuous, but
rather batch -flow, with the sump pumps turning on for a couple minutes multiple times throughout
the day (depending on the current groundwater elevation).

I've prepared a draft permit but am currently waiting on some feedback from our Aquatic Toxicity
Branch, so I apologize for the continued delay. I did have two quick clarifying questions for you:
• What is the timeline for the excavation project? Is the discharge permit needed only for the
duration of the excavation/construction, or will it be needed as a permanent, long-term
solution for the foreseeable future?
• Will the discharge be continuous or episodic?

Notice of Intent to Issue a NPDES wastewater permit.
The North Carolina Environmental Management Commission proposes to issue
a
NPDES wastewater discharge permit to the person(s) listed below.
AP Peabody & Gregson LP requested a new groundwater remediation discharge
permit (NC0090093) for 810 West Peabody St in Durham County. Facility dis-
charges into Ur to Ellerbe Creek/Neuse River Basin. Currently, tetrachloro-
ethene, trichloroethylene, 1,2-cis-dichloroethylene, Bis (2-ethylhexyl) phthalate,
MTBE, vinyl chloride, acetone, and pyrene are water -quality limited. Written
comments regarding the proposed permit will be accepted until 30 days after
the publish date. The Director of the NC Division of Water Resources may hold
a public hearing should there be a significant degree of public interest. Interest-
ed persons may visit the DWR at 512 N. Salisbury Street, Raleigh, NC, 27699.

In order to provide more convenience, control, and security to our permittees and assist them in
processing their transactions, the Division of Water Resources is currently transitioning towards
