You know I tried to appear before city council last the meeting to air my issues. I am trying again next week on 2 May. I
left the last meeting signing up to speak but left without speaking due to the Shaw Zoning issue that attracted hundreds of
folks. I would have been a whisper in room of shouting people.
You know what I am really after is the infrastructure down my street for me to make a sewage connection to my
residence. Being within 937 feet of the closest carolina water service sewage manhole just drives me crazy that I am not
offered a connection.

1. There was no Clean Water Act and no U.S. EPA in 1965. The first permit issued for Kings Grant was in 1986.
2. State and federal regulations require that the dischargers select the most environmentally conservative of the
financially available alternatives for discharge. At the time the first permit was issued, a discharge permit fit that
description. The current availability of sewer should be an impetus for the permittee to connect the subdivision
and cease discharging. However, doing so would cost them money. They would own a WWTP for which they
have no use, and into which they have made monetary investments. That problem was the basis of the court
decisions that took away our authority to force connection to sanitary sewer in situations like these. The courts
held that private utility owners have a right to make money from the infrastructure investments they made —
installation of sewer lines, installation of a WWTP, etc. The right to make money off such investments was seen
as more important than the environmental benefit of discharge elimination.
3. You are correct. The Memorandum of Agreement between EPA and North Carolina was last updated in 2007.

1. That is quite an environmental mouth full "having to live with the sins of the past" (i.e. making a poor environmental
decision in 1965 and having to live with it for ever?????)
2. What ever happened to polluters had to exercise "best practices" when it came to environmental pollution
issues??? As better environmental procedures became available the polluter was required to upgrade their procedures to
the "best practice" available?
3. Don't you folks run the discharge program at the discretion of the Environmental Protection Agency?

In regard to your question as to why the discharge from NCO062219 is not piped to Raleigh's collection system, the
Division can't force a facility to connect to sewer when it is available. Court cases brought against the Division took away
that authority.
We would greatly prefer that the discharge be eliminated by connection to a sanitary sewer collection system, but we
cannot require it.

I have noted that Carolina Water Service has received a construction permit from NC Environmental for the construction
and addition of equipment in support of NPDES Permit NC0062219. When Carolina Water Service requests an increase
in discharge that the additional tank and equipment will support will there be an opportunity for public comment? If so
when?

I was mistaken in my earlier message. The expansion phase was approved in 1993, not 2005.
The permittee requested the expanded flow phase, most likely in the event that additional homes were added to the
subdivision.
The rationale for allowing the expansion and the limits applied to the expanded flow phase are in the attached wasteload
allocation package from 1993.

Could you please tell me what the justification and rational was for the approval of an increase in discharge by a multiple
of three times (.07 mgd to 0.21 gd)?

The subject permit was issued in January 2018, after having been placed at Public Notice on 11/19/2017. Public Notice
was made online and via legal ad in the Raleigh News & Observer.
The permit has two flow phases: 0.07 MGD and 0.21 MGD. Additional wastewater equipment must be constructed before
the 0.21 MGD flow is allowed.
To date, that construction has not occurred. The flow limit is still 0.07 MGD.
The two flow phases have been in the permit since 2005.
