SUBJECT: NOTICE OF VIOLATION

Dear Ms. Shatley:
On June 13, 2023, Division of Water Resources staff Tricia Lowery conducted a routine compliance inspection at
Jefferson WTP, permit NC0083470. ORC Tim Church and BORC David Webb were present during the inspection.
A review of records, data, treatment components, structures, and the outfall was completed. This inspection
reflected non-compliance with the subject permit.
The following violation was noted:
1. Pursuant to Part I, Paragraph A. (3.) of the permit, Jefferson WTP was to begin monitoring of and achieve
compliance with the Total Copper limit specified in Part I, Paragraph A.(1.) no later than March 31, 2022. In
working toward that goal, Jefferson WTP was to have developed and submitted to DWR a corrective action plan no
later than November 1, 2021. In addition, Jefferson WTP should have submitted reports updating DWR on steps
taken to achieve this goal by November 1, 2022.
Please take immediate action to fully resolve the violation listed above.
Please be aware that pursuant to North Carolina General Statute (NCGS) 143-215.6A, the Division may assess civil
penalties not to exceed $25,000 per day against any person who fails to fully comply with the requirements of a
permit issued pursuant to NC General Statute (NCGS) 143-215.1, as is NC 0083470.
