The Division of Energy, Mineral and Land Resources(DEMLR)has reviewed your submittal of the No
Exposure Certification for Exclusion from NPDES Stormwater Permitting form,received on August 25,
2022. The Division is unable to concur with your certification of no exposure.
Based on an inspection of your facility,Winston-Salem Regional Office staff found the dust collection
system is exposed to stormwater, and used pallets and open top dumpsters were located outside
uncovered. The Division cannot grant your requested exemption from permit coverage when industrial
activities or materials are exposed or have the potential to be exposed.Please apply for coverage under an
NPDES General Permit. Information can be found at deq.nc.gov/SW-industrial.
