I hope that you are doing well. Three Oaks is assisting the Town of Cary with the subject project. Originally, we had
acquired an SOA from RES for the EBX Neuse 1, LLC and Environmental Banc & Exchange (EBX) to cover the buffer
mitigation required for the project. However, when I went back to officially secure the credits recently, I was informed
that they are no longer available. I had checked with other banks previously and they also did not have any credits.
Therefore, I have reached out to NCDMS, who has provided the attached DMS Mitigation Acceptance Letter for the
project. I have also attached a copy of our agent authorization form to allow me act on the Town's behalf. Could we
update the mitigation credit provider to NCDMS for this project? Please let me know if you have any questions or
require any additional information.
