Breedlove NCDOT Division 14 PDEA Engineer North Carolina Department of Transportation 253 Webster Road Sylva, North Carolina 28779 Dear Mr. Breedlove: Subject: Mitigation Acceptance Letter: Division 14 Project – TIP Number R-5861, US 19 / 29 Improvements from Georgia State Line to US 64 / 74, Cherokee County The purpose of this letter is to notify you that the North Carolina Department of Environmental Quality – Division of Mitigation Services (NCDEQ-DMS) will provide the mitigation for the subject project. Based on the information received from you on May 22, 2023, the impacts are located in CU 06020002 of the Hiwassee River basin in the Southern Mountains (SM) Eco-Region, and are as follows: Stream and Wetlands River Basin CU Location Eco- Region Stream Wetlands Cold Cool Warm Riparian Non- Riparian Coastal Marsh Impacts Hiwassee 06020002 SM 0 3,013.000 0 0.280 0 0 *Some of the stream and/or wetland impacts may be proposed to be mitigated at a 1:1 mitigation ratio. See permit application for details. Currently DMS does not have cool stream credits in this service area and commits to implementing sufficient cold stream and riparian wetland mitigation credits to offset the impacts associated with this project as determined by the regulatory agencies in accordance with the In-Lieu Fee Instrument dated July 28, 2010. If the above referenced impact amounts are revised, then this mitigation acceptance letter will no longer be valid and a new mitigation acceptance letter will be required from NCDEQ-DMS.
