The Town of Bailey appreciates the opportunity to respond to the above referenced
notice of violations issued June 26, 2023 regarding the flow frequency violation.
The plant was within compliance for the entire February period, but the values
recorded by the flow meter were added to the report; however, due to a clerical
error when completing the report, a note from the operator was omitted indicating
the non-function of the flow meter. We have amended the report indicating that
the flow is being estimated.

It is always our goal to remain in compliance with regulations set forth by the
Division of Water Resources. It is our request that our cooperation and action in
these matters be taken into account by the Division when proceeding with
