Patrick and Kevin,
Please feel free to call me if you need clarification on anything.
On June 6, 2023, the Division of Water Resources (Division) received your application requesting a
401 Water Quality Certification from the Division for the subject project. The Division has
determined that your application is incomplete and cannot be processed. The application is on-hold
until the following information is received:
1. Permit Drawing Sheet 10 of 50 (Site 2 Profile) - The length of the profile is— 163 feet and
does not match the plan view length of 119'. Can stream impacts be minimized by reducing
the culvert length to match the 2:1 fill slopes? [15A NCAC 02H. 0506(b)(1)] There are
proposed lateral and channel change ditches on either end of this proposed pipe.The pipe
needs to outlet into the base/bottom of these ditches therefore it requires the longer length
of pipe to avoid any erosion issues by outleting at that higher 2:1 fill slope elevation. The
profile plan sheet has been reviewed and revised to make sure the exact lengths of pipe and
channel change are shown in plan and profile to match the proposed inlet/outlet design
needs. Impacts did not change as a result.
2. Please provide a detail at the outlet of Stream SD (Site 10), Stream SF (Site 16B), Site 22, Site
23a, and Site 29 inlet. [15A NCAC 02H .0502(c)] These outlets are standard riprap pads per
NCDOT STD. 876.02 but shown only on banks due to jurisdictional flow-See the attached
2018 standard drawings for "Guide for riprap at pipe outlets" for dimensions.
3. Permit Drawing Sheet 19 of 50 (Site 6). In order to meet avoidance and minimization
requirements, explain why the fill slopes (4:1) cannot be steepened to avoid impacts for
Wetland WB. Can the stormwater system be shifted south to also avoid impacting Wetland
WB? [15A NCAC 02H. 0506(b)(1)] The drainage outlet is currently in the existing ditch line and
we want to avoid another channel change near this wetland if possible. Due to ROW we
cannot steepen the slopes and reduce impacts to the wetland. Steepening slopes to 2:1
requires guardrail and extending the project limits along-Y3-. Adding guardrail would
increase the shoulder width 3' and cause additional impacts.
4. Why is the stream impact needed at Site 12 Stream SE (52 If)?Can this be avoided? [15A
NCAC 02H. 0506(b)(1)] We are plug/filling the existing 18" cmp under the road at-L-73+50.
In doing this, we are removing the flow to this jurisdictional stream therefore it is a total take.
5. Site 16C. The blue line JS entering from the east does not appear as an impact, but it is within
the fill. Please provide clarification. . [15A NCAC 02H .0502(c)] This feature was not classified
as jurisdictional, our printing levels show all water as blue, however without the JS linestyle it
is just considered a ditch and no impacts are calculated.
6. Site 17 (Inset D). Why is the impact at Site 17 needed? It appears to be outside of the fill
slope. [15A NCAC 02H .0502(c)] Temporary easement for the construction of the -DR11- is
required and we anticipate pieces of construction equipment being inside this piece of
easement/edge of pond. Additionally there is an existing pipe to be removed and this will
require additional room/impacts to do so.
7. Site 20,21 (Gold Branch). Will the 8x9 RCBC be backfilled with native material and rip rap per
NCWRC recommendations? [15A NCAC 02H .0502(c)] YPq
8. Station 145+50 RT. Is the blue line stream coming out of the 12" RCP accounted for as an
impact? [15A NCAC 02H .0502(c)] This feature is not jurisdictional (same as above, the
pentable shows this water as blue) and no impacts will need to be quantified.
9. Please provide the mitigation approval letter from the NC Division of Mitigation Services. I did
not see that letter in the application. [15A NCAC 02H. 0506(c)]
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested
information for the proper consideration of the application. Please provide your response by July
22, 2023. If all of the requested information is not received, the Division will be unable to approve
the application and it will be denied as incomplete. The denial of this project will necessitate
reapplication to the Division for approval, including complete application and the appropriate fee.
