Please feel free to call me if you need clarification on anything.
On June 6, 2023, the Division of Water Resources (Division) received your application requesting a 401 Water Quality
Certification from the Division for the subject project. The Division has determined that your application is incomplete
and cannot be processed. The application is on‐hold until the following information is received:
1. Permit Drawing Sheet 10 of 50 (Site 2 Profile) ‐ The length of the profile is ~ 163 feet and does not match the
plan view length of 119’. Can stream impacts be minimized by reducing the culvert length to match the 2:1 fill
slopes? [15A NCAC 02H. 0506(b)(1)]
2. Please provide a detail at the outlet of Stream SD (Site 10), Stream SF (Site 16B), Site 22, Site 23a, and Site 29
inlet. [15A NCAC 02H .0502(c)]
3. Permit Drawing Sheet 19 of 50 (Site 6). In order to meet avoidance and minimization requirements, explain why
the fill slopes (4:1) cannot be steepened to avoid impacts for Wetland WB. Can the stormwater system be
shifted south to also avoid impacting Wetland WB? [15A NCAC 02H. 0506(b)(1)]
4. Why is the stream impact needed at Site 12 Stream SE (52 lf)? Can this be avoided? [15A NCAC 02H. 0506(b)(1)]
5. Site 16C. The blue line JS entering from the east does not appear as an impact, but it is within the fill. Please
provide clarification. . [15A NCAC 02H .0502(c)]
6. Site 17 (Inset D). Why is the impact at Site 17 needed? It appears to be outside of the fill slope. [15A NCAC 02H
.0502(c)]
7. Site 20,21 (Gold Branch). Will the 8x9 RCBC be backfilled with native material and rip rap per NCWRC
recommendations? [15A NCAC 02H .0502(c)]
8. Station 145+50 RT. Is the blue line stream coming out of the 12” RCP accounted for as an impact? [15A NCAC
02H .0502(c)]
9. Please provide the mitigation approval letter from the NC Division of Mitigation Services. I did not see that
letter in the application. [15A NCAC 02H. 0506(c)]
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please provide your response by July 22, 2023. If all of the requested
information is not received, the Division will be unable to approve the application and it will be denied as
incomplete. The denial of this project will necessitate reapplication to the Division for approval, including complete
application and the appropriate fee.
