Greetings,
On behalf of Faith & Claus Platt and Carl & Deanna Pettersson (Pettersson Coastal LLC), we would like to
address concerns set forth in the February 7 communication from Holly Snider of the Division of Water
Resources which placed this project review on hold.
An initial comment regarding dredge or fill activities of submerged aquatic vegetation habitat as defined
in 15A NCAC 051 .0101 stated that the docking facility is located adjacent to mapped SAV habitat and the
proposed maintenance dredge footprint contained suitable SAV habitat. An updated SAV and SAV habitat
layer current through 2021 was forwarded to our office on March 16. SAV habitat at this location
remained unchanged with no new mapped SAV since the 2007 and 2015 mapped polygons included on
the original application submittal. The proposed maintenance dredge boundary continues to remain
outside of the most recently mapped SAV habitat polygon (2015), and no SAV has been mapped in the
immediate vicinity of the dredge footprint since that time. In coordination with the Division of Marine
Fisheries (DMF), a 5' buffer outward from the 2015 SAV polygon is proposed to alleviate any potential for
impacts to SAV habitat in this location due to the proposed maintenance dredging. Due to the shallow
maintenance dredge depth proposed (-2' NLW) compared to existing water depths as confirmed on
October 10, 2022 by DCM, this additional avoidance and minimization should adequately address agency
concerns by providing a much greater than 2:1 slope toward the 2015 SAV habitat. Please see the attached
updated figure set for reference.
Alternatives to minimize maintenance dredging were initially considered during the feasibility portion of
the project. Alternate to extending the docking facility to the % water body width limit, Davey Resource
Group (DRG) proposed relocation of the docking facility to the USACE right-of-way to be in line with the
adjacent existing concrete peninsula to the south to minimize the proposed maintenance dredging
footprint. The Division of Coastal Management (DCM) determined that the peninsula did not establish a
pierhead line and that going past the % waterbody width does not appear to gain any water depths.
Finally, the boundary between the -2' NLW and -3' NLW proposed maintenance dredge depth has been
shifted towards the Intracoastal Waterway as an effort to more accurately align with the enclosed
permitted 2004 water depth figure. The applicants are only proposing maintenance dredging be

performed to restore water depths that were present at the time of the 2004 permitting. Please see the
attached updated figure set for reference.
Considering the additional stated avoidance and minimization, assessment of alternatives, and
adjustments to the proposed maintenance dredge depths, we believe this adequately addresses DWR,
DMF, and WRC agency concerns, but please let us know if you have any questions or need anything in
addition to remove the application hold and continue regulatory review. Thank you for your assistance.
