Each of your items requested is repeated for reference, in italics, followed by the corresponding additional information. A. The PCN states that the right-of-way in which the project occurs is to be acquired by the Town of Indian Trail. Has the right-of-way acquisition by the Town been finalized? If yes, please provide documentation. Alternatively, please provide Agent Authorizations from each property owner of parcels within the project area. All ROW has been acquired for the project. A compiled set of ROW documentation is attached. B. The PCN did not include a delineation of the project site. Please provide a delineation of the project area. The original delineation was submitted as a PJD request, and field verified by Crystal Amschler. A copy of the original PJD request is attached. C. Please complete the attached Aquatic Resources Upload Spreadsheet for all aquatic features located within the proposed project area. The aquatic resources should be added to the "AgResources" tab of the spreadsheet. An aquatic resources upload sheet is attached and includes the resources found within the project area, South Fork Crooked Creek and wetland "WZ" delineated by others. Other wetland areas noted in the PJD are outside the project area and not included. Note that the information for WZ may need edited based on the delineation by others. D. Please add labels to the permit drawings that correspond to all aquatic features included on the Aquatic Resources Upload Spreadsheet. South Fork Crooked Creek and wetland WZ are labeled on the revised impact maps attached. Ms. Meagan Jolly SAW-2022-02727 Page 2 of 3 June 6, 2023 E. The proposed right-of-way appears to encroach upon a large wetland polygon depicted north of the proposed roadway (refer to Sheet 2 of 5 of the provided permit drawings). Do the limits of disturbance extend outside of the right-of-way depicted on the drawings? If yes, please provide a drawing depicting the proposed limits of disturbance. No encroachment of the ROW is planned in the wetland area north of the roadway. The ROW line does not intersect the wetland. The NCDOT standard ROW symbol intersects the wetland but the ROW passes through the center of the symbol, therefore no impacts are proposed. F. Regional Condition B. (Riprap), Section a. of the Wilmington Regional Conditions states: "Filter cloth must be placed underneath the riprap as an additional requirement of its use in North Carolina waters. The placement of filter fabric is not required if the riprap will be pushed or "keyed" into the bank of the waterbody. A waiver from the specifications in this Regional Condition must be requested in writing." Please clarify if filter cloth will be placed underneath the proposed riprap bank stabilization areas, or if you are requesting a waiver from this condition. If filter cloth will be used, please note this on the permit drawings. Filter fabric will be used, and a depiction showing that has been added to the details in the attached revised impact maps. G. Regional Condition 9. (Culvert Placement), Section a. of the Wilmington Regional Conditions states: "Placement of culverts and other structures in streams shall be below the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches, and 20% of the culvert diameter for culverts having a diameter less than or equal to 48 inches. If the culvert outlet is submerged within a pool or scour hole and designed to provide for aquatic passage, then culvert burial into the streambed is not required." 1 did not see an indication of culvert burial in the plans. Please provide a plan view that addresses the 1' culvert burial requirement, or additional information to support a waiver from this condition, if applicable. The culvert will be buried to meet this condition. The culvert survey report (CSR) for the project is attached and includes more detail regarding the culvert design and construction. H. The PCN references a Statement of Availability from RES Yadkin 05 Umbrella Mitigation Bank for the proposed permanent stream impacts, but the letter referenced was not included in the electronic files received by the Corps. Please provide the Statement of Availability letter from RES. The SOA was included in the ePCN but may not have made it through the transmittal process. This SOA is attached, along with a DMS Acceptance for the mitigation proposed for the newly identified wetland WZ. Ms. Meagan Jolly SAW-2022-02727 Page 3 of 3 June 6, 2023 1. 1 did not see a Division of Water Resources Pre -Filing meeting request in the project documents; please provide documentation that a pre filing meeting request was submitted to the Division of Water Resources. A Pre -Filing Email was submitted on 8/1/22 and a copy of that is attached. In addition to the above responses, and per our conversations, the Town is willing to comply with a condition for a moratorium on tree clearing if the tricolored bat is listed at the time of construction commencing. If the listing occurs after construction has begun, a moratorium on tree clearing for any portion of the project not already cleared would be acceptable. The attachments referenced in our responses are included in a compiled PDF file, with electronic bookmarks for ease of navigation, with the exception of the Waters Upload spreadsheet. A copy of this submittal is being provided to the NC Division of Water Resources through their electronic submittal portal for issuance of a revised 401 Certification for the project.
