Re: Proposed Deed Restrictions
Elliott Place Subdivision
Ms. Finn:
I am developing the Elliott Place Subdivision. I have not
finalized the Deed Restrictions, however I intend to fully comply
with protective covenant requirements of 15 NCAC 2H.1003(a).
Subject to the counsel of my attorney, the Deed Restrictions will
include the following restrictive covenant:
"No more than 13,459 square feet of any lot shall be
covered by structures and/or paved surfaces, including
walkways or patios of brick, stone, slate or similar
materials. This covenant is intended to insure
continued compliance with the current stormwater runoff
rules adopted by the State of North Carolina and
therefore benefits may be enforced by the State of North

We will also include in the Deed Restrictions the following:

This office has reviewed the subject sedimentation and erosion
control plan. We find the plan to be acceptable. HOWEVER, THIS
IS NOT A GRADING PERMIT.
Please be advised that a copy of the approved soil erosion plan
and a copy of issued grading permit must be available at all
times at the site.

New Hanover County's Soil Erosion and Sedimentation control
program is performance oriented. Requiring protection of the
natural resources and adjoining properties. If following the
commencement of the project it is determined that the plan is
inadequate to meet the requirements of the New Hanover County
Soil Erosion and Sedimentation Control Ordinance, this office may
require revisions in the plan and its implementation to insure
compliance with the ordinance.
Recognizing the desirability of early coordination of
sedimentation and erosion control, I would like to arrange a
pre -construction conference with owner/agent, grading contractor,
engineer, and myself. Proceed with the placement of the planned
erosion control measures; these will be inspected at the
pre -construction conference. Please contact this office to set
the date of the pre -construction conference at which time you
shall be issued the grading permit. However, this permit will
not preclude any other permits or approvals necessary for
beginning or completing this development.
Erosion control measures to be installed prior to grading:
(1) All slopes to be on 3' (run) to l' (rise) ratio.
(2) All C.A.M.A. and State drainage requirements are
adhered to.
(3) Rye shall not be used as a permanent cover.
(4) Construction exit to be located where construction
traffic encounters a paved surface.
(5) Silt fence shall be installed where needed to protect
the estuarine system.
(6) A revised plan must be submitted to cover sewer
construction and future development prior to work in
these areas.
