The Division of Water Quality received a copy of the letter you received from Tony Dees
with the Carteret County Health Department, dated January 23, 2004. The letter
concerns the installation of a "stormwater drainage device" that is prohibiting natural
drainage in the subdivision. For some background information, the Division of Water
Quality began issuing stormwater management certifications and permits for the sole
purpose of maintaining water quality in January of 1988, under NCAC 15A 2H.1000.
Limiting the amount of built -upon area on a per lot basis and limiting the piping are two
things that the Environmental Management Commission had determined would meet
the anti -degradation policy of North Carolina. Because piping increases the velocity of
the runoff and does not offer the nutrient uptake and sediment removal abilities that
grassed swales do, its use is limited to under roads to get runoff from one ditch to the
other.
The Division of Water Quality issued a low density Stormwater Management Permit for
Hidden Bay on October 5, 1992. The approved plan shows a 30 lot subdivision, with
each lot limited to a maximum of 4,400 square feet of built -upon area. No piping is
shown nor has any been approved. If the drainage device you have installed is a pipe,
please remove it and establish a vegetated Swale with side slopes of 3:1 or flatter. We
encourage you to work with your neighbors to correct drainage problems in a manner
consistent with the stormwater permit.
Enclosed is a copy of the stormwater permit and the application. If you have a copy of
the recorded deed restrictions, I would appreciate it if you would send me a copy to the
address below. Your attorney should have provided you with the covenants and deed
restrictions at closing. If you have any questions, please do not hesitate to call me at

It has come to our attention that you have constructed a stormwater drainage device which is
prohibiting the natural flow of water from properties within the subdivision.
We are encouraging you and all adjoining property owners to work together in solving the
drainage problems which exist in this area. When drainage problems begin to cause problems
with on -site wastewater systems, the Environmental Health Division will have to get involved in
order to remedy the situation.
We strongly recommend that all parties involved work together and hope that legal action will
not be necessary in correcting these drainage problems.
