You have our approval, in accordance with the attached conditions, to dredge in 3,433 square feet
wetlands and 237,000 square feet of waters for the purpose of expanding an existing manufacturing facility at
SR 1166 adjacent to the Pamlico River, as you described in your application dated 6 January 1997. After
reviewing your application, we have decided that this fill is covered by General Water Quality Certification
Number 3112.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non - Discharge and Water Supply Watershed regulations. Also this approval will expire
when the accompanying 404 or CAMA permit expires unless otherwise specked in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a heating, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401

which involves increasing the size of an existing boatbasin, access canal and entrance channel.

FOUNTAIN POWERBOATS
Beaufort County
The applicant's property is a 46.26 acre site off SR 1166 in Beaufort County. The site is
within the City of Washington's exhate'rCilorial planning jurisdiction (see enclosed letter from city
concerning this matter). Located on the property is the Fountian Powerboat manufacturing
facility. Access to the site from the PUnlico River is provided by an existing canal which is
located near the western property line. At the southern end of the access canal is a boatbasin
which is mostly surrounded by manufacturing buildings. Dredge and Fill and CAMA Major
Development permits have been issued in the past for maintenance excavation within the canal and
basin. Located between the canal on the west, the manufacturing facility on the south, the eastern
property and the Pamlico River on the north is a large area of wooded swamp wetlands. The
wetland area is dominated by cypmss, various species of gums, myrtles, etc. These wetlands have
been delineated by the Corps of Bnginws. The remainder of the property, which is not being
utilized for manufacturing or consist of wooded swamp, remains in agriculture at this time.
The applicant is proposing to expand the existing manufacturing facility. Generally the
proposal is to widen the existing canal, basin and offshore channel to a depth of -8' at NWL to
allow for the construction of a larger class (60' - 701) boat.
Specifically, the following is proposed:
(1) The enlargement of the existing boatbasin by excavating an area of highground
along the north side of the existing basin. The area will be excavated in
agrieultmnl lands to a depth of -8' at NWL. Also, maintenance excavation will be
done within the existing basin to a depth of -S' at NWL. The basin averages
approximately -5.4' at NWL at this time. When completed the new basin will have
a length of 350' and a width of 150'. All spoils are to be placed on adjacent
highground.
(2) The widening and maintenance excavation of the existing access canal, The 900'
long canal, which averages approximately -5.1' at NWL, will be maintained to a
depth of •8' at NWL. Also, the canal which now averages approximately 60' in
width will be widen to a maximum of 100' by the excavation of an area along the
eastern side of the canal. This excavation will consist of an area of highground
approximately 370' long by approximately 35' wide, and an area of wetlands
approximately 300' long by 11' wide. All spoils are to be placed on adjacent
highground.
(3) The widening and maintenance excavation of the existing access channel. The
1,930' long channel which averages -5.1' at NWL will be maintained to a depth

of -8' at NWL. Also, the canal which now averages approximately $0' in width
will be widened to a maximum of 100' by the excavation of an area along the
eastern side of the canal. This excavation will consist of an area approxlmatrly
1,830' long by approximately 20' in width. All of this excavation will be
conducted with a clamshell bucket with spoils being deposited on a barge then off
loaded on highground at tk site.
(4) The moving of four of the existing channel markers to the east edge of the new
channel.
(5) The constnxxion of a 65' long by 20' wide travel lift within the northwest corner
of the new basin. See plats for details.
(6) The construction of 830' of concrete bulkhead at or near the newly creetad NWL
along the north Bide of the basin and along the eastern edge of the canal. This
bulkhead will be baekfilled and will only be placed adjacent to highgtound.
(7) The amstrucdon of 420' of wood bulkhead also along the eastern edge of the canal
at or now the newly crewwd NWL This section of bulkhead will connect to the
concrete bulkhead at the point where the wetlands have been delineated. This
section of bulkhead will he constructed to the height of the adjacent wetland and
will not be backfilled.
(8) The relocation of an existing 8" potable water line and an existing 2" LP gas line.
The lines will be relocated underneath the newly created basin as shown on the
attached plats.
Envi mental Imam
If the project is conducted as proposed the following environmental impacts will occur:
(1) Approximately 40,950 sq. ft. of highground will be excavated due to increase in
size of the boatbasin and entrance canal.
(2) Approximately 54,000 sq fl. of open water will be excavated due to maintenance
of existing boatbasin and entrance canal.
(3) Approximately 3,433 sq. ft. of wetland vegetation will be excavated due to the
entrance canal widening.
(4) Approximately 183,000 sq. ft. of open water will be excavated due to the
maintenance within and the widening of the entrance channel.

Please reference the application of Fountain Powerboats for Department
of the Army (DA) authorization and a State Water Quality Certification to
expand an existing manufacturing facility and increase the size of an existing
boatbasin, access canal and entrance channel, on property located off State
Road 1166, adjacent the Pamlico River, near Washington, in Beaufort County,
North Carolina. Your receipt of this letter verifies your acceptance of a
valid request for certification in accordance with Section 325.2(b)(ii) of
our administrative regulations.
We are considering authorizing the proposed activity pursuant to
Section 404 of the Clean Water Act, and we have determined that a water
quality certification is required under the provisions of Section 401 of
the same law. A Department of the Army permit will not be granted until
the certification has been obtained or waived.
According to our administrative regulations, 60 days is reasonable
for State action. Therefore, if you have not acted on the request, or asked
for an extension of time, by March 16, 1997, the District Engineer will deem
that waiver has occurred.
