We have been asked to respond to your letter by the new property owner, C.W. and Carol Properties, Inc. 2. In response to "Inspection" item 1, we are enclosing two (2) copies of a revised site plan that reflects the existing and proposed conditions on the site. This revised plan shows that the site remains in compliance with the allowable impervious area reflected in the permit of 121,188 SF. As such, we see no need to modify the permit other than a name and ownership change as has been previously applied for by the new owners. 3. In response to "Inspection" item 2, the new owner has agreed to correct the curve in the outlet pipe. This will be accomplished prior to September 30, 2013. 4. In response to "Inspection" item 3, the new owner has agreed to remove the cattails prior to September 30, 2013. 5. In response to "Transfer — Request for Additional Information and Check Return", we are enclosing a letter from the new owner, C.W. and Carol Properties, Inc. indicating their wishes to accept the permit as is and accepting the responsibility for obtaining compliance to the permit. Also enclosed is documentation of property transfer. Thank you for returning the $40.00 check. Skvarla, III, Secretary Subject: Notice of Inspection — Non Compliant, Request for Additional Information, and Check Return Pike Electric Permit No. SW8 040130 Brunswick County Dear Mr. Walden: Inspection On August 23, 2013, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMRL) inspected Pike Electric in Brunswick County to determine the status of compliance with the State Stormwater Management Permit Number SW8 040130 issued on May 7, 2004. DEMLR file review and site inspection revealed that the site is not compliant with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection report, the following deficiencies must be resolved: Please submit a modification to the project for approval of the revised built -upon area. It was noted that the access road layout has been revised without prior approval from the Division. Per Section 11.10 of the permit, the permittee shall submit and have received approval for revised plans, specifications, and calculations prior to the construction, for any modification to the approved plans, including, but not limited to: "Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc". 2. Please demonstrate that the outlet structure and pipe discharge is functioning as intended and that the required temporary storage volume is available in the pond. It was noted during the inspection that the outlet pipe had a curve that could prevent the pond from appropriately discharging the temporary storage volume. 3. Please maintain the pond in accordance with the approved operation & maintenance (O&M) agreement. Section 111.5 of the O&M agreement requires cattails to be removed when they cover 50% of the basin surface area. During the inspection it was noted that cattails covered the majority of the basin surface area. Per Section 111.1 of the permit, the permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. Please inform this Office in writing before September 30, 2013, of the specific actions that will be undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the requested information, or to respond to this letter by the due date, may initiate enforcement action including the assessment of civil penaltieup to $25,000 per day. If a written plan of action is not submitted to this office by Septembe 2013 then DEMLR staff will re -inspect the site and issue a Notice of Violation if the listed deflcl ncies have not been addressed. ,i0y� Wilmington Regional Office 127 Cardinal Drive Extension, Wilmington, North Carolina 28405 Phone: (910) 796-7215 / Fax: (910) 350-2004 Additionally, on August 13, 2013 a Name/Ownership Change Form was received along with a check for $40. In order to process the transfer of this project, the site must be found in compliance with the permit. If the proposed permittee, C. W. and Carol Properties, Inc wishes to accept the permit with the outstanding compliance issues, then a letter must be provided indicating that they accept responsibility for obtaining compliance in accordance with the state stormwater permit. Once the site is found in compliance or the proposed owners provide a letter accepting responsibility for the compliance issues, the following information must be submitted in order to transfer the permit: 1. Legal documentation of the property transfer to the new owner or a sales contract or purchase agreement indicating the proposed permittees intent to purchase the property. According to the Divisions records, this project has not been transferred before. The first transfer of a stormwater permit is free. Accordingly, Check No. 1836 in the amount of $40 is being returned.
