MCLAMB, single, CAROL LYNN BURGESS, single, KENNE TH H. BURGESS, JR., and
spouse SONYA P. BURGESS, single, JO ANN B. THACKER and spouse JAMS
WESLEY THACKE R, SYLVIA AYERS, single, SAMMIE JEAN RHODES and spouse
JOSEPH LAC RHODES, JR. (Collectively being the heirs of James C. Burgess) 1425
Overh*lls Road, Linden, NC 27406, hereinafter called "GRANTOR" to LEGACY HOME
CONSTRUCTION, INC., a North Carolina Corporation, 415 Pinehurst Ave., Southern
Pines, NC 28388,"GRANTEE'1$.
WHEREAS, James C. Burgess acquired a 102 acre parcel of land by and through that
deed recorded in Deed dated December 11, 1946 and recorded in Deed Book 302, Page 387,
Harnett County Registiy; and
WHEREAS, dames C. Burgess died an Janualy 8, 2013 and his estate was probatedin
Harnett County, North Caro I 'Ina (13 E43) and the estate is now closed; and
VMEREAS, James C. Burgess left a life estate 'in the subject property to his brother
Clifton F. Burgess and Clifton F. Burgess passed away on April 10, 202 1.
WHEREAS, Sam Cameron Burgess, an hek of James C. Burgess, passed away on
Jantiary 4, 2016
and he was

WHER EAS, Sammie Jean Rhodes is the residual Whel*r of Sam Cameron Burgess; and
WHEREAS, Kemieth H. Burgess Sr., are heir of James C. Burgess, predeceased James C.

and the terms of the submitter agreement with the Harnett county Register of Deeds.

Burgess (Kenneth Sr. passed away on November 24, 2003). His only child was Kenneth H.
burgess, Jr., who inherited his share by and through the Will of James C. Burge.Ss;and
WHEREAS, George Burgess, an heir of James C. Burgess, passed away on September 1,
2016,
and his wife passed away October 15,
2016 and h*ls
share has passed to his wife and then
to his
children Jo Ann Thacker and Sylvia
Ayers through
her Will; and
WHEREAS, Winfard L. Burgess, an heir of James C. Burgess, passed away December
25, 2017 haying been predeceased by his wife; and
WHEREAS, Winfard L. Burgess was predeceased by two children (Daniel R. Burgess
and Wl'nfard L. Burgess, Jr.), neither of whom had ch*lldren, spouse or Wilds.; and
WHEREAS, Carol Lynii Burgess is the only heir of'Winfaid L. Burgess.
W I T N E S S E T H, that the Grantor,in consideration of valuable considerations
provided by the Grantee, the receipt of which is hereby acknowledged, has bargained and sold
and by these presents does bargain, sell, grant and convey undo the Grantee, all of Grantor's fee
simple 'Interest in that certain dot or parcel of land sifiiated in Township.,
Harnett County, North Carolina, more particularly described as follows:

This is not the p6mary residence of the Grantor,,
TO HAVE AND TO HOLD the aforesaid tract or parcel of land and all privileges and
appurtenances thereunto belonging to the Grantee in fee simple, grantor covenants with the
Grantee, that Grantor is seized of said premises in fee simple, has the right to convey the same in
fee simple; that titre is marketable and free and clear of all encumbrances, and that Grantor will
warrant and defend the title against the claims of all persons whomsoever except for the
exceptions hereinafter stated. Title to the property hereinabove described is subject to the
following exceptions:

Exhibit A
Beginning at a new stake corner on the eastern margin of the New Road or
Highway and runs thence a new line surveyed December 9, 1946, North 56 deg
East 4540 feet to lightwood stake two red oaks pointers, old corner in McCormick
Division; thence with the McCormick division line dividing the High land from the
Rivet Land North 88 West approximately 52.50 chains to stake and corner with
Tingen land; thence with all the line of Tingen land South 2 East 20 chains to stake
and corner with Tingen; thence with Tingen line about South 71 West
approximately 715 feet to the eastern margin of the said New Road; thence with
the eastern margin of the said New road South 14 deg 34 min East 1120 feet to the
beginning, containing 102, acres, including the cemetery.
