Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This facility discharges in the Neuse River Basin (NRB). All streams in the NRB have been designated as nutrient sensitive waters (NSW) as a result of algal bloom problems in the estuary. The North Carolina Environmental Management Commission recently adopted rules establishing the Neuse River Basin Nutrient Sensitive Waters Management Strategy for the reduction of phosphorus and nitrogen inputs. The point source rule (15A NCAC 213.0234) is intended to reduce total nitrogen (TN) discharges by 30% by 2003. It specifies that individually permitted wastewater discharges to the NRB with permitted flows less than 0.5 MGD in 1995 shall be allocated a collective annual mass TN load of 155,400 pounds/year. This is equivalent to an allocation in the range of 5 - 10 mg/L TN for each small discharge. Although no TN limit appears in this permit, your facility may receive a TN limit in the neat permitting cycle. All facilities with permitted flow greater than or equal to 0.5 MGD are receiving a TN limit in this permit cycle. The Division recommends that you evaluate the cost of installation for nutrient removal facilities in the event that -a nutrient limit is imposed on your plant. It is also recommended that alternative discharge options be evaluated such as such as spray irrigation, subsurface systems, wastewater reuse, or connection to a larger regional system. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Discharges into Stony Creek, classified as WS-III NSW in the Neuse River Basin. Approximately 0.5 miles downstream of the discharge is a small pond just before Stony Creek's confluence with the Eno River. Estimated drainage area and flows at the site based on 1983 USGS info: USGS No. 0208502950 Stony Creek At Eno, N.C. DA=8.6 mi2 QA= 8.63 cfs S7Q10 = 0 cfs W7Q10=0.2 cfs 30Q2--0.3 cfs Permitted for 0.006 MGD with tertiary limits of 6/2/6 in the summer and 12/4/6 in the winter. Also have a TP limit of 1 mg/l and monitoring for TN. TP is measured twice a month (per request of the facility) and the limit is given in a quarterly average. The DWQ compliance system is not able to highlight a quarterly TP limit. Recorded monthly values for the past two years appear to exceed the quarterly limit with no notation of a permit limit exceedance. A review of SOP for the former Instream Assessment Unit showed the NSW strategy for wasteload allocations for the Falls Lake Watershed. It was classified as Nutrient Sensitive Waters in December, 1983 including subbasin 030401. For all new and expanding facilities having come into existence on or since December 1, 1983, a TP limit of 2 mg/l would be assigned. Compliance at that time would be based on quarterly average of weekly samples. Dale Overcash of P&E, recommended The Total Phosphorus limit in 1986 (Facility was then Carden's MHP proposed to discharge into a UT Stony Creek). He noted that phosphorus removal was recommended for this facility because it was being upgraded to meet assigned limits. A TP limit of 1 mg/l was recommended. Summary NCO037869 Page 2 Compliance review: BOD, TSS, and NH3 exceedances in 6/97. There was another NH3 exceedance in 8/95. Overall, the plant is now in compliance with effluent limits and appears to be well operated to meet the stringent limits that have been assigned. According to the 1992 staff report, there was a history of noncompliance and the facility had previously been under SOC in 1990 until relocation of the discharge point to Stony Creek. Recommend renewal of existing conventional limits with a modification of monitoring frequency to monthly for the TP limit. VV�Vi v According to the old NSW strategy, Arbor Hills should have been given a limit of 2 mg/l for TP. With the new strategy for the Neuse Basin, the limit may need to be deleted, but with the small pond downstream, the TP limit may have been assigned in 1986 for protection of WQ in the pond. There is no instream data for TP to determine if there are any problems. Instream data for DO show that DO upstream of the discharge point is consistently below 5 mg/I, however there are no recorded instances of DO below the discharge being less than 5 mg/l. There have been problems with the lab taking other parameters properly. I am reluctant to remove the TP limit completely, maybe it should be upgraded to 2 mg/l. Thomas Harden, of the subject facility; however, no return responses were received prior to on -site investigation. Therefore, an on -site investigation was conducted without the facility's assistance. As a result, regional staff was unable to gain complete access to the treatment facilities due to a locked, wooden gate. It was not possible to determine from visual analysis if any problems with the treatment units exist. However, an inspection of the monthly discharge monitoring reports revealed very few violations of the NPDES Permit monthly average and daily maximum limitations. In addition, the facility has maintained compliance with the permit's measurement frequency requirements. The above facility's sludge management disposal plan uses an aerobic digester to concentrate and partially digest the volatile content of the sludge.
