Dear Mr.Wyatt,
This office has reviewed the subject erosion and sedimentation control plan. We find the
plan to be acceptable with modifications and hereby issue this letter of Approval with
Modifications. The Modifications Required for Approval are listed on the attached page.This
plan approval shall expire three (3) years following the date of approval, if no land-
disturbing activity has been undertaken, as is required by Title 15A NCAC 4B .0129.
As of April 1, 2019, all new construction activities are required to complete and submit an
electronic Notice of Intent (eNOI) form requesting a Certificate of Coverage (COC) under the
NCG010000 Construction General Permit. After the form is reviewed and found to be
complete, you will receive a link with payment instructions for the $100 annual permit
fee. After the fee is processed, you will receive the COC via email. As the Financially
Responsible Party shown on the FRO form submitted for this project,you MUST obtain the
COC prior to commencement of any land disturbing activity. The eNOI form may be accessed
at deq.nc.gov/NCG01. Please direct questions about the eNOI form to the Stormwater

Program staff in the Raleigh central office. If the owner/operator of this project changes in
the future, the new responsible party must obtain a new COC.
Title 15A NCAC 4B.0118(a) and the NCG01 permit require that the following documentation
be kept on file at the job site:
1. The approved E&SC plan as well as any approved deviation.
2. The NCG01 permit and the COC, once it is received.
3. Records of inspections made during the previous 12 months.
Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic
inspection to ensure compliance with the approved plan.
North Carolina's Sedimentation Pollution Control Program is performance-oriented,
requiring protection of existing natural resources and adjoining properties. If, following the
commencement of this project, it is determined that the erosion and sedimentation control
plan is inadequate to meet the requirements of the Sedimentation Pollution Control Act of
1973 (North Carolina General Statute 113A-51 through 66),this office may require revisions
to the plan and implementation of the revisions to ensure compliance with the Act.
Acceptance and approval of this plan is conditioned upon your compliance with Federal and
State water quality laws, regulations, and rules. In addition, local city or county ordinances
or rules may also apply to this land-disturbing activity. This approval does not supersede
any other permit or approval.
Please note that this approval is based in part on the accuracy of the information provided
in the Financial Responsibility Form, which you provided. This permit allows for a land-
disturbance, as called for on the application plan, not to exceed the approved
acres. Exceeding the acreage will be a violation of this permit and would require a revised
plan and additional application fee.You are requested to file an amended form if there is any
change in the information included on the form. In addition, it would be helpful if you notify
this office of the proposed starting date for this project.

MODIFICATIONS

For final plan approval, please provide the requested information below.
1. Please note that referencing Figure 8.06a of the Erosion and Sediment Control
Planning and Design Manual for a round pipe flowing full with a tailwater condition
(Tw< 0.5) the minimum length of a rip rap splash pad is 18'. The dimension given in
plan sheet detail EC17 (Pipe Outlet Protection) is 8'. This may be a typographical
error. Please review this dimension listed on plan sheet C-502. {G.S. 113A-57 (3)}.
2. Please include the 5 isolated inlet protection measures within the limits of
disturbance shown on Initial and Intermediate Erosion Control Plan Sheets C-105 and
C105 respectively. These are located along the western edge of the disturbed area.
Please just enclose the small areas of the culvert inlet protection measures within the
limits of disturbance. These small areas should not affect the overall disturbed area.
{NCG01000}.
3. If used on the site, please show on the plans the locations all topsoil or subsoil
stockpiles. Please show these structures on the plan surrounded by sedimentation
fence, leaving an access for ingress for equipment. The silt fence should be located 5
feet from the toe of the stockpile. These structures should be located at least 50 feet
from any stormwater inlet. If the stockpile is to remain inactive for more than 7 days,
the structure should be stabilized. {G.S. 113A-57 (3)}.

4. Please add a note to the plans that any off-site borrow and/or waste required for the
project must come from a site with an approved erosion control plan,a site regulated
under the Mining Act of 1971, or a landfill regulated by the Division of Solid Waste
Management. Trash or debris from demolition activities or generated by any
activities on site must be disposed of at a facility regulated by the Division of Solid
Waste Management or per Division of Solid Waste Management or Division of Water
Resources rules and regulations. {15A NCAC 04B .0110).
5. Please provide on the plan sheet construction typicals a detail of the COIR baffles to
be used in temporary sediment basin #1. {G.S. 113A-57 (3)}.
6. Please change callout on plan sheet C-104 to see plan detail of the temporary skimmer
basin on sheet C-503. This detail is shown on plan detail sheet C-504. {G.S. 113A-57
(3)}.
7. Please change the references to contact Buncombe County Erosion Control
throughout the Construction Sequences on plan sheet G-003 to NCDEQ at (828) 296-
4500. NCDEQ is the permitting authority for erosion and sediment control on this
site. Buncombe County may be the permitting authority for post-construction
stormwater devices on this site. {G.S. 113A-57 (3)).
8. Consideration should be given to avoiding Sericia Lespedeza as it is considered an
invasive species, per NC State University/At&T University Cooperative Extension.
The Extension recommends the following alternative native species: Switchgrass
(Panicum virgatum), Splitbeard Bluestem (Andropogon ternarius), Beggarlice
(Desmodium spp.), Partridge Pea (Chamaecrista fasciculata). {Comment}
9. Please change the references from Lincoln County to Buncombe County or NCDEQ
shown in notes 5 and 13 listed under Erosion Control Notes on plan sheet G-003. {G.S.
113A-57 (3)).

10. Please add to the Construction Sequence and/or Erosion Control Notes on plan sheet
G-003;
a) That no major grading activities or basin construction are to take place during
wet weather or periods of predicted wet weather,
b) That the site must be"storm ready"before any extended breaks in construction
activities including weekends,
c) To file and electronic Notice of Termination (e-NOT) after a final close out
inspection report is received from NCDEQ Land Quality Section Program
