Subject: Technical Correction of NPDES Permit NCO061425
Willow Valley WWTP
Watauga County
The Division has reviewed your permit file in response to a discrepancy noted by staff in the NC
DENR Winston-Salem Regional Office (WSRO). WSRO staff rioted that you were using a different version
of the effluent page than the one in their files. We have determined that the Ownership change
modification issued to your firm on May 2, 2014 was created using an outdated version of the permit text.
The 2014 modification lacks the Daily Maximum limit for ammonia nitrogen (NH3 as N), lacks permit
section I. A. (2), and also specifies an incorrect method of flow monitoring. This modification is issued to
correct these errant omissions, and is pursuant to the requirements of North Carolina General Statute 143-
215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated October 15, 2007 (or as subsequently amended). Insert the attached pages into your permit
and discard the old pages.
This modified permit includes the following changes from your current permit:
➢ The effluent limitations and monitoring requirements in Section A. (1) have been corrected to
the same requirements as the 2013 permit renewal. Section A. (2) has been restored.
If any parts, measurement frequencies or sampling requirements contained in this modification are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this letter. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings
(6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this
decision shall be final and binding.
This permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements
to obtain other permits which may be required by any other Federal, State, or Local governmental

There shall be no discharge of floating solids or visible foam in other than trace amounts

means of disinfection is required. Total Residual Chlorine monitoring requirements and limits are
applicable if chlorine compounds are used for disinfection.

A. (2) TEMPORARY MEANS OF DISINFECTION
In the event that the wastewater treatment plant's ultraviolet (UV) disinfection system should fail,
underperform, or otherwise be removed from effective service, the permittee or his agent should
immediately inform the Surface Water Protection Section staff of the Winston-Salem Regional Office of
this development and discuss temporary, alternate means for disinfection of the effluent.
If chlorine compounds are used as temporary means of disinfection, the total residual chlorine (TRC)
concentration of the effluent must be monitored on a daily basis while this method of disinfection is in use
and values must be reported on the discharge monitoring report. TRC, in the effluent may not exceed 28
µg/L; therefore, dechlorination methods may also be necessary to ensure protection of water quality in
the receiving stream.
In the event that TRC monitoring should occur, the Division shall consider all effluent TRC values
reported < 50 µg/L to be in compliance with the pen -nit. However, the Permittee shall continue to record
and submit all values reported by a North Carolina certified laboratory (including field certified), even if
these values fall below 50 µg/L.
Use of a disinfection system other than the permitted UV system during circumstances not deemed as
emergency and/or temporary (replacement of lamps, lamp cleaning or maintenance, etc.) will be
considered a violation of the terms of this permit.

The 2013 page is correct, and it matches BIMS. That's what I will send them as a correction.

The issue that has come up is that the 2 effluent limits pages state different methods for flow.
The one we have (that's in BIMS) says flow is continuous.
The one they have (that's not in BIMS) says flow is Weekly and continuous.

George — I've attached two documents.
The 2013 renewal has the correct effluent page. That's probably the one at the WSRO.
The 2014 ownership change mod has an older version of the effluent page — and no, I don't know why that one was
used. The page Willow Valley sent you is from the 2014 mod. Its only difference from the 2013 effluent page [apart
from formatting] is the deletion of the daily max NH3 limit.
I'll issue a correction to put the daily max limit back in.

The attached limits page does not match ours for NC0061425. They are saying that this page is in their current permit.
Also, it does not match our previous limits page for the permit that was issued on January 1, 2008 and expired on Sept
30, 2012. Does this page match an older permit?
