Atlas Environmental (Atlas) is submitting the enclosed nationwide permit 39 modification
package on behalf of the applicant, Justin Bennett of Phelan -Bennett Development, for
unavoidable impacts to aquatic resources at the Gateway Northwest Logistic Center project
review area. Atlas staff completed a stream and wetland delineation on March 28, 2023, and
observed one perennial stream and three wetlands.
The project purpose is for the construction of two industrial buildings (Building 1: 166,370
square feet and Building 2: 132,395 square feet) with driveways, commercial vehicle parking,
employee parking, utilities, and stormwater control measures. Two permanent stream impacts
to channel CH 100 have been previously permitted for this project with the action ID: SAW-
2020-00256. The original stream impact of 90 linear feet (-0.006 acre) was permitted in 2020.
An additional stream impact of 148 linear feet (-0.010 acre) was permitted in 2021. Both
impacts were for the installation of a culvert.
After a change of the civil engineering company working on the project in 2023 it was
determined that an additional 56 linear feet of permanent stream impact would be necessary.
Three wetland features were also documented during the field evaluations on March 28, 2023
that will require unavoidable impacts. Impact S1 is a permanent stream impact that will affect
56 linear feet (-r0.003 acre) of perennial channel CH 100 in the Western portion of the review
area. All three wetlands within the Western portion of the review area abut channel CH 100.
Wetland impact W1 (WL 1000: -r0.011 acre), impact W2 (WL 1100: —0.006 acre), and impact
W3 (WL 1200: —0.002 acre) will receive permanent fill related to road construction and site
grading. The site has been designed and engineered and avoid and minimize impacts to the
greatest extent possible. The permit modification will allow for vehicular access around building
two and two points of access for the site. The total impacts under this permit modification
include an additional 56 linear feet (-0.003 acre) of permanent stream impact and

approximately 0.019 acre of permanent wetland impact. Including the previous permitted
impacts there will be a total of approximately 294 linear feet (-0.019 acre) of stream impact and
approximately 0.019 acre of wetland impact. Due to cumulative impacts being less than the
stream and wetland mitigation thresholds no mitigation is being proposed.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordancewith the attached
Conditions, your application signed and dated 12/3/2021, and the enclosed plans Delta Park Creek Piping/ Brookline Park dated
12/27/2021. Any violation of the attached conditions or deviation from your submitted plans may subject the permitteeto a stop
work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide and/or regional general permit
authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide and/or regional general
permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided
it complies with all requirements of the modified nationwide permit. If the nationwide and/or regional general permit authorization
expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the
nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon
the nationwide and/or regional general permit, will remain authorized provided the activity is completed within twelve months of the
date of the nationwide and/or regional general permit's expiration, modification or revocation, unless discretionary authority has been
exercised on a case -by -case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You
should contact the NC Division of Water Resources (telephone 919-807-63 00) to determine Section 401 requirements.
