The NC Division of Water Resources (NCDWR) is responsible for the issuance of the Section 401 Wa[er Quality Certification for ac[ivi[ies tha[ impact Waters of the U.S., including wetlands. Under I SA NAC 21I .0500 (.0506[4]), it is the NCDW R's responsibility to ensure that projects do not result in cumulative effects or cause a violation of downsheam wa[er qualiry based on reasonably anticipa[ed future impacts. During [he review 1 notice that it is stated in the No�able E��vironmenta! Fea��mes section on page eight that Haskett Creek and Penwood Branch are both listed on [he Final 2014 303(d) list; however, it is not stated what the impaimients are. Haskett Creek (AU 17-12a) is listed for dissolved oxygen and Penwood Branch (AU 17-i2-I) is lis[ed as impaired for poor benthos rating. Ac[ions which may exacerbate conditions leading [o the listings should'be avoided. Based on the information presented, the NCDWR agrees that a Land Use Study Assessment (LUSA) is likety needed. Please keep us apprised oP any additional informarion or revisions to the cumulative impact document(s), including any LUSA [ha[ may be developed. Thank you for requesting our input at this time.
