Just following up on this one, as I believe that we’re only a couple weeks away from the 60 day clock
for DWR.
As stated in my email below, the applicant has agreed to Lyle’s proposed conditions and will remove
the temporary haul road on or before 3/1/2026.

Dear Mr. Bob Zarzecki,
I have reviewed the PCN for the above referenced project and have the following questions/comments.
1. The proposed project consists of industrial development requesting authorization through NWP 39 for
discharges of fill material within waters. Per NWP 39, the discharge must not cause the loss of greater than 1/2-
acre of non-tidal waters of the United States. Based on the review of the proposed project and previously
authorized projects the cumulative loss of waters is 0.5 acre (see below).

At such point that the Corps can verify the use of NWP for this project, we would include Special Conditions that
require the following:
a. A Pre‐construction meeting whereby the permanent loss impact limits would be staked by a licensed surveyor
and reviewed in the field, including measuring the impact footprint. If the footprint of loss exceeded 0.031 acre,
we would then rescind the use of NWP 39, and the applicant would then have the option to either proceed via
the Individual Permit process, or resubmit a request to use NWP 39 providing additional avoidance and
mitigation of impacts (below the impact limit threshold);
b. An as‐built survey of the wetland fill showing the footprint of permanent loss impacts overlaid on the
stream/wetland delineation. If the footprint of wetland loss impacts exceeds 0.031 acre, we would then rescind
the use of NWP 39, and the applicant would then have the option to either proceed via the Individual Permit
process, or re‐construct the crossings such that they fit NWP 39 impact limit thresholds.
Please review the above conditions and advise if this is how you would like to proceed. If the impacts are further
avoided or minimized these conditions could be updated accordingly.
2. Please provide an approximate timeframe for the removal of the temporary haul road. The Corp would include a
special condition such as (a.) below but would need to define the timeframe in order to ensure that the impacts
are temporary.
a. The permittee shall inform the U.S. Army Corps of Engineers Wilmington District Raleigh Field Office Project
Manager of the date work within jurisdictional waters commenced. The discharge of dredged or fill
material, as proposed, may be placed into waters of the United States for no more than six months without
specific written permission from the Corps.
Please submit the above information within 30 days of receipt of this Notification or we may consider your application
