Dear Mr. Boone,
I am writing in response to the letter dated May 10, 2022 Notice of Violation & Intent to Issue Civil
Penalty NOV-2022-DV-0124. In your letter you ask that we address the causes of non-compliance,
remedial actions, and all other actions taken to prevent the recurrence of similar situations.
The cause of this event was due to heavy rains in the area (2.3inches) and Inflow/Infiltration in an aging
sewer collection system.
The remedial actions taken thus far have been a sewer rehabilitation program in which we spent 1.1
million dollars for slip lining and manhole rehabilitation in 2014 and $60,000 spent on a CCTV inspection
of our known problem areas in late 2020. Since the completion of the CCTV inspection, we have been
doing point repairs on the system.
We have continued to maintain a Capital Improvement Plan in which we are allocating funds annually
for sewer system improvements. Part of the monies issued the Town from the Covid relief, will be used
on I&I repairs.
As previously mentioned, we have found that part of the issue is due to a manhole and its ability to
handle a convergence of flows from 2 10" pipes into a 12" pipe leading to the wastewater treatment
facility. We continue to weigh our options, as funding becomes available, to rectify this. One such option
we are looking at is running a parallel line to WWTP. We completed all the manhole renovations and
raised them where we were able.

Funding for these projects is limited and is an issue we are dealing with. We respectfully request that a
