Each issue or incidence of non-compliance was caused by an unusual or abnormal circumstance or condition and in no instance was the non-compliance caused by lack of proper operation, mechanical or maintenance failure. Incident 5/2/2020 — (email sent to DWQ Paul DiMatteo 5/20/20) "On April 30th heavy rains caused plant influent flows of app. 12mgd which is double the treatment capacity of the plant. This flow caused a minor washout of solids which, after reviewing official results, will result in a weekly non-compliance on the April DMR for T5S and a weekly and monthly non-compliance for BOD. Flows did not exceed containment capacity so there was no bypass but the high flows did cause a permit non-compliance. As usual I have attached the flow chart for the event and should you require additional information please let me know." The non-compliance actually occurred as a weekly non-compliance the first week of May. Incident 5/21 &23/2020— (email sent to DWQ Paul DiMatteo 5/22/20) "Over the past 2 days (May 21 & 22) we had prolonged moderate to heavy rains that caused influent flows to marginally exceed (15.5mgd) the containment capacity of the plant. These flows caused an extended period of solids wash out which will certainly lead to a non-compliance for both the weekly and monthly May DMR along with a very minor bypass of the UV treatment unit. Incident 5-31-20— (email sent to DWQ Paul Dimatteo 5-28-20) "On Wednesday/Thursday (sample date 5-28-20) we had flows up to app. 15mgd that exceeded the treatment capacity of the facility and caused a solids wash out which will cause a permit noncompliance for the last week of May. Incident 7/11&18/2020 — (email sent to DWQ Paul DiMatteo 7/22/20). "During the week after the 41h of July 2020 we began noticing, what we believe to have been an anti -bacterial foaming agent/constituent in the influent stream entering the plant from the Northside pump station. This continued circulating through the system throughout the week and caused serious problems with both fecal kill and nitrification and, according to reported results, caused two weekly and one monthly non-compliance for NH3 and a weekly BOD non-compliance. Around the 1511the system began recovering and as of the beginning of this week we seem to have recovered and are back operating within all permit parameters. I just wanted to give you guys a heads up so when you see the non -compliances for the July DMR you will know the circumstances behind it and I've attached a picture for documentation and reference. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1. If you wish to provide additional information regarding the noted violation, request technical assistance, or discuss overall compliance please respond in writing within ten (10) business days after receipt of this Notice. A review of your response will be considered along with any information provided on the submitted Monitoring Report(s). You will then be notified of any civil penalties that may be assessed regarding the violations. If no response is received in this Office within the 10-day period, a civil penalty assessment may be prepared. Remedial actions should have already been taken to correct this problem and prevent further occurrences in the future. The Division of Water Resources may pursue enforcement action for this and any additional violations of State law. If the violations are of a continuing nature, not related to operation and/or maintenance problems, and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by Consent. Reminder: Pursuant to Permit Condition 6 in Section E. the Permittee is required to verbally notify the Regional Office as soon as possible, not to exceed 24 hours, from first knowledge of any non-compliance at the facility including limit violations, bypasses of, or failure of a treatment unit. A written report may be required within 5 days if directed by Division staff.
