Per our discussion on Monday, the Division has reviewed the additional information that was submitted on March 15
and requires additional clarification to finalize our review. Please provide the following information within 30 days of
receipt of this request.
1. On April 11, 2023 the Division met with you and project representatives to ensure that the GPS coordinates for
Feature B Start Pt 1 were accurately documented in the Buffer Determination Letter issued January
2021. Please see the attached minutes from that meeting. Please provide an updated response to item 2 in the
February 17, 2023 Request for Additional Information. Specifically, per 15A NCAC 02B .0611(c)(1)(D), please
provide information that demonstrates that the applicant did not cause the hardship.
2. In your response to item 1 in the February 17, 2023 Request for Additional Information you have clarified that
the site is being specifically designed for an end user with a defined design/siting criteria. You have also
provided information to indicate that the Eagle Crest Industrial Park is the only site available in Wake County
that meets the user's criteria. From available information online, the Eagle Crest Industrial Park, includes
multiple tracts, at least one of which appears to be available for a similarly sized project (see attached
conceptual plan). Given the additional land available within the Industrial Park, please provide additional
information to demonstrate that the project meets 15A NCAC 02B .0611(b)(2): specifically that the project
cannot be accomplished in a manner that would avoid or better minimize disturbance and/or cannot be
reconfigured to better minimize disturbance.
