There are a few changes in the draft attached here from the existing permit. These changes are
summarized below.
• Regulatory Citations - Language has been added where necessary in the permit to provide regulatory
citations for permit requirements. This includes updates to citations that have been changed with
recent rule revisions.
• Electronic Reporting - Permit language has been modified to be consistent with the finalization of

the permits listed above and establish more stringent nutrient limits upon finding that such limits
are necessary to prevent the discharges from causing localized water quality impacts in the
receiving streams.
e. The Permittee may request that its permits be modified to rescind these combined limits and
establish individual mass discharge limits for each facility. The Division may, after written
notification to the Permittee, rescind these combined limits and establish individual mass or
concentration discharge limits for each facility if it determines that the combined limits do not
support the objectives of the Falls Lake or Neuse River Estuary Nutrient Management Strategies.
The Division shall provide for public review of the proposed permit modifications and include in
the permit an appropriate schedule of compliance for the proposed nutrient limits.

A. (3) CALCULATION AND REPORTING OF NUTRIENT LOADS
[G.S. 143-215.1 (b)]
a. The Permittee shall calculate monthly and annual TN and TP Loads for the Hawthorne Subdivision
WWTP (NC0049662) and for the Wildwood Green WWTP (NC0063614) as follows:
Monthly Discharge Load (pounds/month, TN or TP) = TN (or TP) x TMF x 8.34

TN (or TP) = average Total Nitrogen (or Total Phosphorus) concentration (mg/L) of the
composite samples collected during the month
TMF = Total Monthly Flow of wastewater discharged during the month

8.34 = conversion factor, from (mg/L x MG) to pounds
ii. Annual Discharge Load (pounds/year, TN or TP) = Sum of the 12 Monthly TN (or TP) Loads
for the calendar year.
iii. Combined Discharge Load (pounds/year, TN or TP = Sum of the Annual Discharge Loads for
Hawthorne Subdivision and Wildwood Green Subdivision WWTPs for the calendar year.
b. Reporting of Nutrient Discharges: The Permittee shall report each facility's monthly TN and TP
discharge loads in the facility's discharge monitoring report for that month and each facility's
calendar year TN and TP discharge loads in its December report for that year.
c. Reporting of Combined Nutrient Discharge Loads: The Permittee shall report each calendar year's
combined TN and TP discharge loads as part of the Hawthorne Subdivision WWTP's December
discharge monitoring report for that year using Outfall CO1.
A. (4) ANNUAL LIMITS FOR TOTAL NITROGEN AND TOTAL PHOSPHORUS
[G.S. 143-215.1 (b)]
a. Total Nitrogen (TN) and Total Phosphorus (TP) allocations and load limits for NPDES
dischargers in the Neuse River Basin and Falls Lake watershed are annual loads and apply on a
calendar year basis.
b. For any given calendar year, the Permittee shall be in compliance with the annual TN (or TP)
Discharge Load limit in this Permit if:
i. the Permittee's annual TN (or TP) discharge load is not greater than the effective limit
in this permit, or
ii. the Permittee is a co-permittee member of a TN (or TP) compliance association.
c. If the Permittee is not a co-permittee member of a TN (or TP) compliance association and the
Permittee's cumulative annual TN (or TP) discharge exceeds the effective TN (or TP) Load limit
in this permit at any point during the calendar year, the Permittee is in violation of its TN (or TP)
Load limit, and each day of a continuing violation shall constitute a separate violation.
d. The TN (or TP) limit in this Permit may be modified as the result of allowable changes in the
Permittee's allocation.
i. Allowable changes include those resulting from the purchase, sale, trade, or lease of TN
(or TP) allocation between the Permittee and other dischargers; the purchase of nutrient

offset credit from a mitigation banker or other Division -approved sources;
regionalization; and other transactions approved by the Division.
ii. The Permittee may request a modification of the TN (or TP) Load limit in this Permit to
reflect allowable changes in its TN (or TP) allocation or credits. Upon receipt of timely
and proper application, the Division will modify the permit as appropriate and in
accordance with state and federal program requirements.
iii. Changes in TN (or TP) limits become effective on January 1 of the year following
permit modification unless specified otherwise in the permit. The Division must receive
application no later than August 31 for changes proposed for the following calendar
year.
iv. Application shall be sent to:

e. If the Permittee is a member and co-permittee of an approved TN (or TP) compliance
association, its TN (or TP) discharge during that year is governed by that association's group
NPDES permit and the TN (or TP) limits therein.
i. The Permittee shall be considered a Co-Permittee Member for any given calendar year
in which it is identified as such in Appendix A of the association's group NPDES
permit.
ii. Association roster(s) and members' TN (or TP) allocations will be updated annually and
in accordance with state and federal program requirements.
iii. If the Permittee intends to join or leave a compliance association, the Division must be
notified of the proposed action in accordance with the procedures defined in the
association's NPDES permit.
(A) Upon receipt of timely and proper notification, the Division will modify the
group permit as appropriate and in accordance with state and federal
program requirements.
(B) Membership changes in a compliance association become effective on
January 1 of the year following modification of the association's permit.
f. The TN (or TP) monitoring and reporting requirements in this Permit remain in effect until
expiration of this Permit and are not affected by the Permittee's membership in a compliance
association.
A. (5) TOTAL NITROGEN AND TOTAL PHOSPHORUS ALLOCATIONS

a. The following table lists the Total Nitrogen (TN) allocation(s) assigned to, acquired by, or
transferred to the Permittee in accordance with the Neuse River nutrient management strategy
rule (T15A NCAC 0213.0713) and the status of each as of permit issuance. The allocations in

c. Any addition, deletion, or modification of the listed allocation(s) (other than to correct
typographical errors) or any change to Active status of any of the listed allocations shall be
considered a major modification of this permit and shall be subject to the public review process
afforded such modifications under state and federal rules.
A. (6) TEMPORARY MEANS OF DISINFECTION
[NCGS 143-215.1 (a)]
a. In the event that the wastewater treatment plant's ultraviolet (UV) disinfection system should
fail, under -perform, or otherwise be removed from effective service, the permittee or his agent
should immediately inform the Surface Water Protection Section staff of the Raleigh Regional
Office (919-791-4200) of this development and discuss temporary, alternate means for
disinfection of the effluent.
b. If chlorine compounds are used as temporary means of disinfection, the total residual chlorine
(TRC) concentration of the effluent must be monitored on a daily basis while this method of
disinfection is in use and values must be reported on the discharge monitoring report. TRC in

the effluent may not exceed 22 µg/L; therefore, dechlorination methods may also be necessary
to ensure protection of water quality in the receiving stream.
c. The Division shall consider all effluent TRC values reported below 50 µg/L to be in compliance
with the permit. However, the Permittee shall continue to record and submit all values reported
by a North Carolina certified laboratory (including field certified), even if these values fall
below 50 µg/L.
d. Use of a disinfection system other than the permitted UV system during circumstances not
deemed as emergency and/or temporary (replacement of lamps, lamp cleaning or maintenance,
etc.) will be considered a violation of the terms of this permit.
A. (7) PERMIT RE -OPENER: NUTRIENT MANAGEMENT
[NCGS 143-215.1 (b)] kN
a) Pursuant to N.C. General Statues Section 143-215.1 and implementing rules found in Title 15A of
North Carolina Administrative Code, Subchapter 02H, specifically, 15A NCAC 02H.0112(b)(1) and
02H.0I 14(a), and Part II, Sections B.12 and B.13. of this Permit, the Director of DWR may reopen
this permit to require nutrient management measures for the discharge. The results of water quality
monitoring, modelling or other evaluations may require that conditions for total nitrogen and total
phosphorus control be imposed on this permit.
b) The Division may, upon written notification to the permittee, re -open this permit in order to
incorporate or modify effluent limits, monitoring and reporting requirements, and other permit
conditions when it deems such action is necessary to implement TMDL(s) approved by the USEPA.
A. (8) ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS
[NCGS 143-215.1 (b)]
Federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and program
reports. The final NPDES Electronic Reporting Rule was adopted and became effective on December
21, 2015.

permit (Standard Conditions for NPDES Permits):

1. Reporting Requirements [Supersedes Section D. (2.) and Section E. (5.) (a)l
The permittee shall report discharge monitoring data electronically using the NC DWR's Electronic
Discharge Monitoring Report (eDMR) internet application.
Monitoring results obtained during the previous month(s) shall be summarized for each month and
submitted electronically using eDMR. The eDMR system allows permitted facilities to enter
monitoring data and submit DMRs electronically using the internet. The eDMR system may be
accessed at: https://deq.nc.gov/about/divisions/water-resources/edmr.

If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility
being physically located in an area where less than 10 percent of the households have broadband
access, then a temporary waiver from the NPDES electronic reporting requirements may be granted
and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1.1, 2, 3) or
alternative forms approved by the Director. Duplicate signed copies shall be submitted to the

Monitoring results obtained during the previous month(s) shall be summarized for each month and
reported via the eDMR system no later than the last calendar day of the month following the
completed reporting period. Regardless of the submission method, the first DMR is due on the last
day of the month following the issuance of the permit or in the case of a new facility, on the last day
of the month following the commencement of discharge.
Starting on December 21, 2025, the permittee must electronically report the following compliance
monitoring data and reports, when applicable:
Sewer Overflow/Bypass Event Reports;
Pretreatment Program Annual Reports; and
Clean Water Act (CWA) Section 316(b) Annual Reports.
The permittee may seek an electronic reporting waiver from the Division (see "How to Request a
Waiver from Electronic Reporting" section below).
2. Electronic Submissions
In accordance with 40 CFR 122.41(1)(9), the permittee must identify the initial recipient at the time
of each electronic submission. The permittee should use the EPA's website resources to identify the
initial recipient for the electronic submission.
Initial recipient of electronic NPDES information from NPDES-regulated facilities means the entity
(EPA or the state authorized by EPA to implement the NPDES program) that is the designated entity
for receiving electronic NPDES data [see 40 CFR 127.2(b)].
EPA plans to establish a website that will also link to the appropriate electronic reporting tool for
each type of electronic submission and for each state. Instructions on how to access and use the
appropriate electronic reporting tool will be available as well. Information on EPA's NPDES

Electronic submissions must start by the dates listed in the "Reporting Requirements" section above.
3. How to Request a Waiver from Electronic Reporting
The permittee may seek a temporary electronic reporting waiver from the Division. To obtain an
electronic reporting waiver, a permittee must first submit an electronic reporting waiver request to
the Division. Requests for temporary electronic reporting waivers must be submitted in writing to
the Division for written approval at least sixty (60) days prior to the date the facility would be
required under this permit to begin submitting monitoring data and reports. The duration of a
temporary waiver shall not exceed 5 years and shall thereupon expire. At such time, monitoring data
and reports shall be submitted electronically to the Division unless the permittee re -applies for and is
granted a new temporary electronic reporting waiver by the Division. Approved electronic reporting
waivers are not transferrable. Only permittees with an approved reporting waiver request may
submit monitoring data and reports on paper to the Division for the period that the approved
reporting waiver request is effective.

All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part II,
Section B. (I 1.)(a) or by a duly authorized representative of that person as described in Part II,
Section B. (11.)(b). A person, and not a position, must be delegated signatory authority for eDMR
reporting purposes.
For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR user
account and login credentials to access the eDMR system. For more information on North
Carolina's eDMR system, registering for eDMR and obtaining an eDMR user account, please visit

Certification. Any person submitting an electronic DMR using the state's eDMR system shall make
the following certification [40 CFR 122.22]. NO OTHER STATEMENTS OF CERTIFICATION
WILL BE ACCEPTED:
"I certify, under penalty of law, that this document and all attachments were prepared under my
direction or supervision in accordance with a system designed to assure that qualified personnel
properly gather and evaluate the information submitted. Based on my inquiry of the person or
persons who manage the system, or those persons directly responsible for gathering the information,
the information submitted is, to the best of my knowledge and belief, true, accurate, and complete. I
am aware that there are significant penalties for submitting false information, including the
possibility of fines and imprisonment for knowing violations. "

5. Records Retention [Supplements Section D. (6.)]
The permittee shall retain records of all Discharge Monitoring Reports, including eDMR
submissions. These records or copies shall be maintained for a period of at least 3 years from the
date of the report. This period may be extended by request of the Director at any time [40 CFR
122.41].
