I visited the property Monday
Please see pictures of trees that were cut. I talked to the builder of the home and Mr. Scott, builder told me trees
needed to be removed due to they were dead and would have fallen on the house.

3) Yes construction as mentioned above is reason for the catawba buffer rule. ‐ Please also see attached Septic System
approval letter.
4) see attached water waste system const. Approval.
5) Mulch will be installed in the areas of the buffer, silt fencing was installed also.

Hi Tamara,
Your February 3rd response didn’t include all information needed for the Division to
approve the project. I’ve listed the items that need attention below. Please let me know
if you’d like for your February 3rd response to be considered an incomplete response
and for me to wait for additional information, or if you would like the Division to
continue processing the application with the information received on February 3rd (this
will likely result in a denial and require Buffer restoration to resolve the Notice of
Violation).
2. The attached topographic map does not detail the impacts to the Catawba Buffer.
Please include a map with these details. A close‐up view of the parcel, such as a survey,
with the impacts drawn in will meet this requirement. The two Buffer zones, any
vegetation clearing, and any temporary or permanent structures should be included.
3. The Catawba Buffer Rule includes a Table of Uses that identifies what activities are
allowable, allowable with mitigation, and prohibited. The construction of a new onsite
sanitary sewage system using ground absorption within the Buffer is a prohibited

activity. Please clarify that this was the purpose of the vegetation clearing within the
Buffer. Please also note that the Authorization for Wastewater System Construction
from the Caldwell County Environmental Health Division (attached) approves the septic
system at a location outside the Buffer.
4. This item requires a response. When designing a project that may impact the Buffer,
applicants must first consider all alternatives that accomplish the project purpose
without impacting the Buffer. Essentially, can the project be located outside the Buffer
and still meet its purpose? If it is determined that no alternatives exist, applicants must
then reduce the Buffer impacts to the maximum extent practicable for the project
purpose. They should ask, can I reduce the size or redesign the system to further reduce
impacts? Once applicants have determined that the project impacts cannot be reduced
further, they submit the application with that design. The application requires a
description of this process and the alternatives considered (include why the project
can’t be relocated outside the Buffer and why impacts can’t be reduced in size further).
In your description, please address the Authorization for Wastewater System
Construction from the Caldwell County Environmental Health Division approving the
septic system at a location outside the Buffer.
5. Please clarify that mulch is the only proposed ground stabilized method. Please note,
silt fencing was observed during the site visit. Any structures, such as silt fencing, should
be included on the map described in item 2.
Please let me know as soon as you are able if you intend to provide a follow‐up
response, even if you are still working on addressing the above items, and please let me
know if you have any questions about these items.

On December 30, 2022, the Division of Water Resources
(Division) received your application requesting a Buffer
Authorization from the Division for the subject project.
The Division has determined that your application is
incomplete and cannot be processed. The application is
on‐hold until all of the following information is received:
1. The application requests approval to clear 50
square feet within Zone 1 and 30 square feet
within Zone 2; however, a site inspection on
November 16, 2022, found that 1500 square
feet of Zone 1 and 1580 square feet of Zone 2
had been cleared. Additional clearing was
reported after the site inspection. Please clarify
the correct amount of proposed impacts. [15A

2. The application did not include a map showing
the location and dimensions of the Catawba
Buffer and proposed disturbances to the Buffer.

5. The application did not include plans for best
management practices to be used to control the
impacts associated with the activity, such as
ground stabilization techniques to prevent
other Buffer impacts or water quality violations
to Lake Hickory. Please include this item. [15A

Pursuant to Title 15A NCAC 02B .0611(b)(3), the
applicant shall furnish all of the above requested
information for the proper consideration of the
application. Please provide your response by February
24, 2023. If all of the requested information is not
received, the Division will be unable to approve the
application and it will be denied as incomplete. The
denial of this project will necessitate reapplication to
the Division for approval, including a complete
application package and appropriate fee.
