Ms. Hager,
On December 30, 2022, the Division of Water Resources (Division) received your application, with additional information
provided on February 2, 2023, and February 22, 2023, requesting a Buffer Authorization from the Division for the subject
project. The Division has determined that your application is incomplete and cannot be processed. The application is on‐
hold until all of the following information is received:
1. The revised survey map does not detail the proposed impacts. Dimensions of proposed impacts are not provided
and the location of the Catawba Buffer is not identified. Please provide a revised map that includes dimensions
of the proposed impacts, the location of the Catawba Buffer, and a measurement from a fixed point, such as a
structure or property boundary. [15A NCAC 02B .0611(b)(1)(F)]
2. The purpose of the proposed Catawba Buffer impact is stated to be the construction of a new onsite sanitary
sewage system. However, the authorization issued by the Caldwell County Environmental Health Department
did not approve a septic system at the location of the proposed impact. A project cannot be approved without
an accurate description of the nature of the activity, including the activity’s purpose. Additionally, the
installation of new on‐site sanitary sewage systems that use ground absorption are prohibited within the
Catawba Buffer. Please state the purpose of the proposed activity. The activity must be designated as allowable,
allowable upon authorization, or allowable with mitigation upon authorization by the Catawba Buffer Rule. [15A
NCAC 02B .0611(b)(1)(D); 15A NCAC 02B .0614(10)(m)]
3. An application requesting to impact the Catawba Buffer must include an explanation of why the plan for the
activity cannot be practically accomplished, reduced, relocated, or reconfigured to avoid or better minimize
disturbance to the riparian buffer, preserve aquatic life and habitat, and protect water quality. Your February 22,
2023, response indicates that the authorization issued by the Caldwell County Environmental Health
Department for a septic system meets this requirement. However, the authorization issued by the Caldwell
County Environmental Health Department approved a location outside of the Catawba Buffer, indicating that
the activity can be practically accomplished while avoiding disturbance to the Catawba Buffer. Please provide an
explanation of why the activity cannot avoid impacts to the Catawba Buffer and why those impacts cannot be
reduced. [15A NCAC 02B .0611(b)(1)(G)]
Pursuant to Title 15A NCAC 02B .0611(b)(3), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please provide your response by May 12, 2023. If all of the requested
information is not received, the Division will be unable to approve the application and it will be denied as incomplete.
The denial of this project will necessitate reapplication to the Division for approval, including a complete application
package and appropriate fee.
