This permit, issued on � r=n i12g, 2d15 , is subject to compliance with the application (where consistent with the permit), all app�icable regulations, s�ecial conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonrnen� or civil action; or may cause the permit to be null and void. Brid�e Renlacement 1) All wark authorized by this permit shall be carried out in accordance wi#h the following attached workplan drawzngs (13): 2 dated 3125/14, 3 dated 1/5/15, and $ dated 11/17/14, except as modified herein. 2) In arder to protect anadromous fisheries resources in th.e Perquimans River, no in-water work shall be conducted between February 15fh to June 30��' of any year without prior approval of the N.C. Division af Caastal Management {DCM), in cansultation wiih the U.S. Army Corps of En.gineers. 3} No vegetated wetlands or waters of the State shall be excavated, without pertnit modification. (See attached sheets for Additional Condi#ions) This }�ermit action may be appealed by the permittee or other qualified persans within twenty {20) days of the issuing date. This permit must be accessible on-site to De�artment personnet when the praject is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Al] work must cease when the permit expires on December 31, 2018 In issuing this permit, the Stake of North Carolina agrees that your project is consistent with the North Carotina Coastal Management Program. Departr�ent of Transportation ADDITIQNAL CONDITYONS Permit #55-15 Page 2 of 4 4) No fill material shall be placed at any time in any vegetated wetlands or surrounding waters outside af the alignment of the fill areas as indicated on the attached workplan drawings, without permit modification. 5) s� All fill material shall be clean and free of any pollutants except in trace quantities. Material excavated from high ground areas of the project site may be used in fill areas associated with th� project ar shall be removed from the site and taken to a high ground location. 7} AIl excavated materials sl�all be conf ned above normal water l�vel and landward of regularly or irregularly flooded wetlands behind adequate dikes ar other retaining structures to prevent spillover of solids into any wetlands or surrounding waters. 8) 9) 10) The bridge shall be constructed using top down construction zr�ethodolagies with an offsite detour. Any other construction method may require additional authorization from DCM. All construction access shall be thro�gh the use of the existing bridge, the partially constructed new bridge, and/or existing high ground areas. Construction staging areas shall be located only in upland areas, and not in wetlands or waters of the State. ll) �111 reasonable efforts shall be made to contain all debxis and excess rr�aterials associated with the authorized activities with �he intent that materials and debris do not enter vvetlands or waters of the State, even temporarily. 12} The instaliation and removal of the bric�ge piles shall be accomplished by pile driving ar�dlor the use af a vibratory harnmer. Should the permittee and/or its contractor propose to utilize another type of instatlation, such as jetting or drilled shaft construction, additiona� authorizatian from DCM shali be required. 13) Pilings in open watex fram the existing bridge, as well as any remnant pilings from previous bridges, shall be removed in their er�tirety, except that in the event that a bridge piling breaks during removal and cannot be removed in its en#irety, the bridge pi�ing may be cut off flush with the bed of ti�e water body, ar�d DCM shall be natified of each occurrence within one warking day. 14) The placement of riprap shall be limited to the areas as indicated on the attached workp�an drawings. The riprap rr�aterial shall be clean and free from loose dirt or any pollutant excep# in trace quantities. 15) Any waste materials and debris associated with canstri�ction, demolition, or other activities shall be disposed of at an approved upland site or shall be recycled in an enviranrrzentally appropriate manner provided appropriate authorizations are obtained from any releva�nt state, federal, or local authorities. 16} Live concrete shall not be allowed to contact waters of the State or water that will enter waters of the State. Depa�rtzr�ent of Tra�nsportation ADDITIONAL C4NDITIONS Utili Re�ocations Permit #55-15 Page 3 of � NOTE: The constructian of the new bridge will also require the relocation of telephane, water and power lines. 17} Any utility work associated with this project that is not specifically depicted on t�e attached workplan drawings, or described within the attached permit application, shal� require approval from DCM, either under the a�xthority of this permit, or by the utility company obtaining separate authorization. 1 S) Utilities shall be installed a minimum of 15 feet beiow the existing stream bed, in accordance with the attached workplan drawings. NOTE: Plans an.d specif cations �or the relocation and/ar replacement of potable water snpply lines must be submitted to the N.C. Division of Water Resources, Public Water Supply Plan Review Section for approval prior to construction. Final approval must be issued before r�vater rr�ains are placed into service. Sedinnentation and Erosion Control 19) This project shall conform to all requirements of ti�e N.C. Sedimentation Pollution Control Act and the N.G Department of Transportation's (NCDOT's) Mernarandum of Agreement with the N.C. Division of Energy, Mineral, and Land Resources. General N4TE: This project, including the bridge replacetnent and utility relocations, will permanently impact approximately O.Q9 acres of 404 wettands. This project will teznporarily impact approximately 0.19 acres of 404 wetlands due to hand clearing. This project will terriporarily impact approxirnately 90 linear feet of stream. 20) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work fallowing comp�etion of construction. 21) During bridge construction, the permittee shal� make every attempt ta maintain #he same navigation that is currently possible in the Perquir�ans River, upstream and downstream of the �xisting bridge. 22) The permittee shall exercise all available precautions in the day-to-day operations of the facility to prevent waste fro�n entering the adjacent waters and wetlands. Department of Transportation ADDITIONAL CONDITIONS Permit #55-15 Page 4 of 4 23) If it is detenmined that additional permanent and/or temporary impacts are necessary that are not shown on the attached workplan drawings or described in the authorized perrr�it application, a permit modification andlor additional authorization from DCM may be required. In addition, any changes in the approved pian may alsa require a permit �nodification and/or additional authorization from DCM. The permittee shall contact a representative of DCM prior ta the commencement of any such activity for this determinatian and any pertnit modification. 24} 25) DeveIopment authorized by this penmit shall only be conduct�d on lands owned by NCDOT and/or its right-of-ways and/or easements. The permittee and/or its contractor shall contact Lhe DCM Transportation Project Field Representative in Elizabeth City at (252) 2G4-3901 to request a preconstruction conference prior to project initiation. 26) The N.C. Division of Water Resources {DWR) authorized the proposed project an 2/3/15 (DWR Project No. 15-0049} under Generai Water Quality Certification Numbers 3883 and 3884. Any violation of the Certification approved by DWR shall be consiciered a viola�ion of this CAMA permit. NOTE: NOTE: NOTE: The U.S. Army Cotps of Engineers authorized the proposed project under R�gianal Permit N�.unber 198000291 {COE Action ID No. SAW-2015-00854), which was issued on 4/24115. This permit does nat elim�nate the need to obtain any additional permits, approvals ar authorizations #hat rnay be required. An application processing fee of $475 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements af the Division of Water Resources.
