Craven County Committee of 100, Ltd. Property (100 Industrial Drive, New Bern)
Dear Mr. Frederick:
On May 7, 2015, the Division of Water Resources (Division) received your application dated May 5,
2015, requesting clarification of the buffer rules for the subject project.
Upon review of the proposed project, the Division has determined that this activity is considered
an Exempt Use, per the Table of Uses found in 15A NCAC 02B [ Neuse] .0233(6) under Vegetation
management states "...Removal of individual trees which are in danger of causing damage to
dwellings, other structures or human life.."
On April 24, 2015, Anthony Scarbraugh of the Division met with Jason Frederick with Craven
County Planning Department and Patrick Baker of Craven County Soil and Water at the subject site
to discuss a safety hazard created by a blind spot created by vegetation in Zone 1 of the Neuse
River Buffer off the western stream bank of a tributary of the Neuse River known as Deep Branch
and commercial trucks exiting the Craven County Industrial Park onto Clarks Road. During the
meeting, DWR staff concurred with Craven County employees that the vegetation meets the
Exemption as defined within the Tables of Uses.
This exemption is only valid for the purpose and design that you described in your application. If
you change your project, you may be required to apply for an authorization and /or variance.
This exemption does not relieve you of the responsibility to obtain all other required federal, state
or local approvals.
