Boardwalks in wetlands do not usually require permits. I have highlight the applicable regulation in the attached PDF. If the pond is a Section 404 water only (which it is) a permit is required if there is a discharge of dredged or fill material below the OHWM. Floating docks don't usually involve discharges of fill material. Sincerely, David L. I noticed that she included some small wetland impacts in the application for a boardwalk, and I'm thinking that typically boardwalks don't require 404/401 permitting. Also, a small open water impact was included for a floating dock, and I'm not sure that would require 404/401 permitting either. If you could just let us know, that would be much appreciated.
