The North Carolina Depai�tment ofTransportation (NCDOT) is proposing to make an emergency
repair of a slide on Diamond Creek Road. Recent hea�ry rains and a streatn underctttting the bank
have coutcibuted to a road slope failure. The road is compromised siguiticantly aud lias been
closed. There is � l�igh risk of additional loss of the road into Diamoud Creek due to the steep
fill slope.
NCDOT plans to access tlie toe of tl�e fill slope from the existing roadbed by cutting a ramp
(road) to tlie bottom adjacent to Diamond Creek. Woody debris ai�d any dirt and roek fi•om the
slide will Ue removed fiom d�e stream. Large shot rocl< will be installed aloug Diauiond Creek at
the toe of the road fill slopc in order to bring tlie fill slope baek up to road grade. Efforts will be
made to retaiu auy vegetation contributing ro stabiliry of tl�e slope; however, very little vegetation
eYists.
I am enclosing a PCN application, Rapanos Jurisdictional form, � sketch of the slide area,
photographs, a marked vicinity map and USGS ropographic map.
The North Carolina Natural Heritage Program �vas checked for records of federally threatened
and endaugered species. There are uo species listed in the database for the inunediate vicinity of
the project site; etcept for tlie federally "tlu�eatened" iiortliern long-eared bat. Four to si� tcees
will need to be cut in order to get the access road to the bottom of tlie slope; however, die
removal of these trees should lie withui tlie "interim" 4(d) rule gaidelines for uon-federal
projects. Additionally, tlicre are no records for the entire Diamond Creek watetshed. The project
is limited to a small section of streambauk diat will be stabilized with large shot rock and riprap;
therefore, tlie iuipTCts from this project should be miuimal. For these reasons, we believe tliere
will be "no effecP' on tlu•eatened or endingered species.

Diamond Creek. The actuTl slide has also impacted tl�e project area. Due to the steep terrain and
no structures in the inunediate area of the slide, we believe tl�ere will be "uo effect" ai cultural
resources.

Diamond Creek (DWQ Class C; Tr.) is slio�vn on tlie USGS topographic map as a perennial
stream. The stream has sufficieut flow to support trout and other aqualic life. The chamiel is
well detined and is composed primarily of bedrock and lacks veget�tion. Diamond Creek flows
approximately 0.36 miles to thc Norih Fork Frencl� Broad River. The Nortli Fork French Broad
River at the confluence of Diamoud Creek meets the definition of a Traditional Navigable Water.
For tltese reasons, we believe Uiat Diamond G�eek is a Relatively Permanent Water and is under
tlie juriscliction of the U.S. Army Coips of Eugineers. in order to make tlie �ieeded slope repair, it
�vill be necessary lo impact Waters of the United StTtes in the Prench Bro�d River Basin (HUC
Unit 0601O105). Speci(ically, NCDOT is requestiug to replace laige rock along the stre�mbank
ofDiamond Creek.

To repair a fill slope failure on SR 1322 (Diamond Creek Road) adjacent to Diamond Creek (see attached photos).

An access ramp will be consVucted from the center of Diamond Creek road down to the bottom of lhe fill slope. Trees
and other debris will be removed from the riparian area and slream at the base of the slide. Shot rock will be installed at
the toe of the fill slope along Diamond Creek to prevent the stream from further undercutling lhe road. The road slope will
be reconstructed using large shot rock, riprap and road bond. Trackhoes, dump trucks, sandbags, diversion pipe and
various hand tools will be used to accomplish the work.

The slream will be accessed from an access ramp (road) cut from the middle of Diamond Creek road down to the boltom of
lhe fill slope. The woody clebris and any excess soil in the riparian area and edge of stream will be removed. An impervious
dike (sandbags) will be installed to divert the flow away from the work area.
