On March 22, 2023, the Division of Energy, Mineral and Land Resources received your request
to rescind your coverage under NPDES Stormwater Permit NCS000043. After performing a
facility inspection on April 4, 2023, the Division has determined a permit rescission cannot be
granted at this time. You are required to continue following all monitoring and reporting
requirements of stormwater permit NCS000043.
The current permit expired on March 31, 2020. To date, the Division has not received a permit
renewal application. Operating a treatment facility, discharging wastewater, or discharging
specific types of stormwater to waters of the State without valid coverage under an NPDES
permit is against federal and state laws and could result in fines.
If the facility is in the process of being sold, you would be performing a public service if you
inform the new or prospective owners of their potential need for NPDES permit coverage.
