Accordingly,we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.Environmental Protection Agency dated May 9,1994(or as subsequently amended). The Division received your comment letter of September 5,2001. Responses to your comments are as follows: ➢ Temperature monitoring remains unchanged in the final permit. Daily temperature monitoring is required by 15A NCAC 2B.0508. Temperature monitoring requirements are unchanged from the permit previously issued for this facility. D. The Wastewater Management Plan requirement has been deleted from the final permit. Instead,you must submit documentation showing the availability of sewer connection for the subject facility. The documentation should include any correspondence between your company and the Town of Dallas regarding sewer availability. The documentation must be submitted to the Division's NPDES Unit no later than November 28,2002. It is the Division's mandate to assure the most environmentally sound wastewater disposal alternative is used at all permitted facilities. In order to be certain that the most environmentally sound method is in use for College Park,current information on sewer availability is required. Furthermore,the alternatives analysis required by the previous permit (issued September 20,1996)was not performed. Failure to submit the documentation as specified in Part I.A. (2.) of this permit will result in enforcement action. D Part III.D.has been modified as you requested. If any parts,measurement frequencies or sampling requirements contained in this permit are unacceptable to you,you have the right to an adjudicatory hearing upon written request within thirty(30)days following receipt of this letter. This request must be in the form of a written petition,conforming to Chapter 150B of the North Carolina General Statutes,and filed with the Office of Administrative Hearings(6714 Mail Service Center,Raleigh,North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. Following our review of the information, please find the following comments: • "Temperature" monitoring of the effluent is listed as "Daily"; however, monitoring frequencies for all other parameters, except Total Residual Chlorine, are required only "Weekly". Therefore, CWS would request that Temperature also be monitored "Weekly", which is consistent with all other parameters. • Part A. (2.) Wastewater Management Plan requires that an EAA report be submitted no later than 180 days after the effective date of this permit. CWS strongly objects to this requirement for the following reasons: 1. Rationale for requiring that this Report be submitted applies to new or expanding permits, which this is not. This permit is a renewal of an existing NPDES Permit for an existing WWTP; 2. The submittal of an EAA Report is further covered by Part III, D. in the proposed Permit. • Part III, D. "Requirement to Continually Evaluate Alternatives to Wastewater Discharges". CWS requests that the wording be modified to add: "If the facility is in substantial non-compliance for 3 consecutive months with the terms and conditions... The (2) Permits are as follows: 1) College Park WWTP, NPDES Permit #NC0033421f 2) Kings Grant WWTP, NPDES Permit #NC0032760 These "draft" Permits were received on August 6, 2001 and we have been given 30-days in which to submit responses, if desired. There are at least (2) issues on each Permit which need clarification. One involves the requirement to sample "daily" for temperature. Although all other parameters are required to be tested "weekly" with the exception of total residual chlorine (@ 2/week) , we need to know where the definition for "weekly" sampling is located in the Permit. In previous permits, it was clarified that weekly meant 5-days/week excluding weekends and holidays. However, I cannot find such wording in the draft permits. Also, we feel that the sampling frequency for temperature should only be required as often as the other parameters (weekly) , rather than daily. The other item involves the submittal of an EAA Report within 180 days following the effective date of the final permit. Listed as the reasoning behind this requirement is that it is required for all "new or expanding NPDES discharge permits" . Neither of these permits are new, nor are they expanding. They are renewals for "existing" NPDES Permits. Therefore, CWS would object to this particular requirement. I just wanted to advise you that we will be sending responses for both of these draft permits. Since we are so close to the 30-day deadline, I will be sending these response letters via FedEx or UPS-Next Day. However, I need to know a particular street address in which to send them, as a mail box is not sufficient. Please let me know where these should be sent (street address) , and also clarification of the term for "daily" sampling at your earliest convenience. The September 20, 1996 permit requested alternative analysis as identified in Item E. of Part III of the permit. In talking to Mr. Bruce Hass, contact for Carolina Water Service Inc., of NC, he does not believe that this study has been submitted. No study is located in the Mooresville Regional Office Files. Due to the close proximity of the Dallas collections system it is recommended that this study be completed and submitted to DWQ for review.
