Secondary Road Improvements to SR 1134
The Division of Water Quality staff has reviewed your submittal for a§401 Water Quality Certification
for the aforementioned project. Review of your application revealed that it lacked all of the necessary
information required for making an informed permit decision. The pernut application was deficient in the
following areas:
■ According to the cover letter, your office is unaware that the UTs to Barnes Creek are classiiied as
WS-N, Outstanding Resource Waters. This project must be designed to comply with the
requirements of ORW waters [ 15A NCAC 2B .0225] including sedimentation and erosion control,
30-foot buffers, and handling of stormwater to prevent direct contact with the receiving waters.
■ The project must be designed so that it can comply with the requirements of "Design Standards for
Sensitive Watersheds [15A NCAC 4B .0124].
■ The application must address outlet stabilization in more detail (e.g., how the pipes will be stabilized,
and the amount of rip rap, if any, used at each site).
■ NCDOT must submit a plan.for written DWQ approval to address any headcutting that will occur as a
result of this project.
Therefore, pursuant to 15A NCAC 2H .0507(a)(3), the pernut application is placed on hold until we are
supplied the necessary information. Furthermore, until the information is received by the NC Division of
Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers continue to place
the permit application on hold.
