The Division of Water Quality (Division) personnel have reviewed and approved your application for renewal of the
subject permit. Accordingly, we are forwarding the attached NPDES discharge permit. It is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the U.S. Environmental Protection Agency dated October 15, 2007, or as subsequently amended.
There are no changes to this final permit from the draft permit sent to you on January 18, 2012. The following changes
have been made from the current permit:
Footnote 2 regarding TRC has been updated per the Division's permitting strategy for TRC that accepts a TRC
result from an NC accredited laboratory reported as less than 50 µg/ L as compliant with the permit.
Monitoring for Total Zinc has been changed to Quarterly from Monthly based on RPA results.
In keeping with EPA requirements, the requirement for an annual Priority Pollutant Scan has been changed to
requiring three scans over the permit life. Please refer to Condition A.(3).

to receiving waters designated as the French Broad River within the French Broad River Basin, in
accordance with effluent limitations, monitoring requirements, and other conditions set forth in Parts I,
II, III and IV hereof.
This permit shall become effective April 1, 2012.
This permit and authorization to discharge shall expire at midnight September 30, 2015.

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby revoked. As of this permit
issuance, any previously issued permit bearing this number is no longer effective. Therefore, the exclusive authority to operate
and discharge from this facility arises under the permit conditions, requirements, terms, and provisions included herein.
The Town of Marshall is hereby authorized to:
1. Continue discharging 0.400 MGD of treated domestic and industrial wastewater from an activated -
sludge wastewater treatment facility consisting of the following components:
• Influent bar screen,
• Oxidation ditch with rotary aerators,
• 36 ft. circular clarifier with sludge return,
• 90 degree v-notch weir, ultrasonic totalizing flow meter,
• Aerated sludge -digestion tank with floating mechanical aerator,
• Sludge belt press (polymer added),
• 10,000 gallon sludge holding tank,
• Sludge drying equipment (10 ft x 20 ft wedgewire screen),
• LTV disinfection,
• 12.5% sodium Hypochlorite liquid feed system (Backup chlorination),
• Calcium thiosulfate liquid feed system (Dechlorination),
• 8 - inch gravity outfall with flap valve, and
• 50 KW emergency generator.
This facility is located in Marshall at the Town of Marshall WWTP in Madison County.
2. Discharge from said wastewater treatment works through Outfall 001 to the French Broad River
(see attached map), a stream classified as Class B waters within the French Broad River Basin.

1. Monthly average effluent concentrations for Biochemical Oxygen Demand (BOD5) and TSS shall not exceed 15% of the
respective influent values (i.e. 85% removal).
2. TRC monitoring and limit requirements apply only if chlorine or a chlorine derivative is used in the treatment process.
The facility shall report all effluent TRC values reported by a NC certified laboratory, including field certified. However,
effluent values below 50 ug/ L will be treated as zero for compliance purposes.

A (2). ACUTE TOXICITY PASS/FAIL PERMIT LIMIT (QRTR.LY)
The permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the North Carolina
Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity In A Single Effluent
Concentration" (Revised -July, 1992 or subsequent versions). The monitoring shall be performed as a Fathead
Minnow (Pimephales promelas) 24 hour static test. The effluent concentration at which there may be at no time
significant acute mortality is 90% (defined as treatment two in the procedure document). Effluent samples for
self -monitoring purposes must be obtained during representative effluent discharge below all waste treatment.
The tests will be performed during the months of February, May, August, and November.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGE6C.

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30
days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements performed
in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent
toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required,
the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the
facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No
Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at
the address cited above.
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will
begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will
revert to quarterly in the months specified above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly
monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test
requirement will revert to quarterly in the months specified above.
Should any test data from either these monitoring requirements or tests performed by the North Carolina Division
of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to
include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival and appropriate environmental controls, shall constitute an invalid test and will require immediate
follow-up testing to be completed no later than the last day of the month following the month of the initial
monitoring.

A (3). EFFLUENT POLLUTANT SCAN
The Permittee shall perform a total of three (3) Effluent Pollutant Scans for all parameters listed below. One scan
must be performed in each of the following years: 2012, 2013, and 2014. Analytical methods shall be in accordance
with 40 CFR Part 136 and shall be sufficiently sensitive to determine whether parameters are present in
concentrations greater than applicable standards and criteria. Samples should be collected with one quarterly
toxicity test each year, and must represent seasonal variation [i.e., do not sample in the same quarter every. year].
Unless otherwise indicated, metals shall be analyzed as "total recoverable."

II. Summary
The Marshall W WTP discharges to the French Broad River. The 2011 French Broad Basin plan
lists this portion [AU 6-(54.5)fl of the French Broad as impaired for turbidity, as 11.8% of samples from
Ambient Monitoring Station E5120000 exceeded the standard of 50 NTUs. This encompasses 31.1 miles
from Sandymush Creek to the North Carolina - Tennessee State Line.

data is summarized below in Table 1. The facility's average flows are currently at 18% capacity with the
maximum monthly average flows at 20% capacity.

RPA Analysis
RPAs were performed using January 2009-October 2011 data for copper and zinc. Monitoring for
those parameters is required in the NPDES permit. The facility does have a pretreatment program for one
SfIJ: Deringer- Ney, Inc. This industrial user uses copper, cadmium, and silver to manufacture electrical
contacts. However LTMP data was not included in the RPA analysis since data was not available for this
renewal.
Copper showed reasonable potential to cause an exceedance of water quality standards, however
since this is an action level parameter it will not receive limits; monitoring will remain at monthly. Zinc
did not show RP; sampling will be reduced to quarterly in conjunction with the WET testing.
WET Test Results
The Marshall W WTP has an acute pass/fail WET testing requirement. The facility has passed all
tests administered since February 2007.
Correspondence File Review/Compliance History
Inspection reports prior to 2009 note several pieces of equipment that need repair, including the
UV system, aerators, flow meter, clarifier, etc. There are also reports that routine housekeeping, grass
cutting, and trimming is needed. A Compliance Inspection on 2/25/2011 reported that plant components
have been repaired and placed back in service, and running as often as possible. Housekeeping had been
vastly improved, the site cleaned up and the facility building had been painted.

Hello Mr. McKay,
lust a minor comment about the new draft permit you sent to Region 4 for review.
We find that this permit is rated as a minor/primary, but not in the current priority
watershed.
My only comment is that it would be good to specify in the permit that the most stringent
mercury method be employed for the next rounds of testing and analysis. EPA Method 1631E.
You might also mention (either in the fact sheet or cover letter) the forthcoming TMDL for
mercury could impact future permits based on new sample data and issuance of that TMDL.

Here are my comments for the subject draft permit.
SUGGESTED 2012 DRAFT PERMIT LANGUAGE:
• influent bar screen,
• oxidation ditch with rotary aerators,
• 36 ft circular clarifier with sludge return,
• 90 degree v-notch weir, ultrasonic totalizing flow meter,
• aerated sludge -digestion tank with floating mechanical aerator,
• sludge belt press (polymer added),
• 10,000 gallon sludge holding tank,
• belt filter press with polymer addition
• 10 ft x 20 ft wedge wire screen sludge drying bed,
• ultra -violet disinfection,
• 12.5% sodium hypochlorite liquid feed chlorination system,
• calcium thiosulfate liquid feed dechlorination system,
• 8 - inch gravity outfall with flap valve, and
• 50 KW emergency generator.
In addition:
The correct classification for this facility is Class II (as of 4-23-2002)
It is incorrectly listed as Class III on the fact sheet and in BIMS.
ARO recommendation:
ARO recommends issuance of the subject permit with the changes listed
above.

Here's the latest info and last three inspections for the Town of Marshall's WWTP DRAFT
permit (see attached).
WWTP Class: II
Note: BIMS shows this facility as being a Class III (as of 2005), however it was reclassified
from a Class III to a Class II on 4-23-2002.
Please correct this (or have Charles correct this).
WWTP type:
0.40 MGD wastewater treatment consisting of: bar screen; oxidation ditch with rotary
aerators; 36 ft dia circular clarifier with sludge return; 90 degree v-notch weir; ISCO

3210 Ultrasonic totalizing flow meter; aerobic sludge digestor with floating mechanical
aerator; 10,000 gal sludge holding tank; HydroCal belt filter press with polymer addition
& 10 ft x 20 ft wedgewire screen sludge drying bed; UV disinfection with standby -power;
liquid feed sodium hypochlorite (12.5% bleach) chlorination; liquid feed calcium
thiosulfate dechlorination; 8-inch gravity outfall with flap valve; and 50 KW emergency
generator.
Sludge Management:
Stabilized to a Class B product (under EPA 503 regs) 20 days with 40% MLVSS
reduction; dewatered using a HydroCal belt filter press with polymer addition & 10 ft x
20 ft wedgewire screen sludge drying bed (produces a cake product with an 85%
moisture content). Sludge cake is stored in a lined 20-yard roll off dumpster. Testing
for TCLP (Toxicity Characteristic Leaching Procedure) performed and accepted by
Madison County Solid Waste (sludge hauling contractor) and ultimate disposal in the
Lakeway Recycling and Sanitation, Inc. landfill (a Class I private landfill # SNL 32-0280)
in Tennessee.
Toxicity Concentration:
The Instream Waste Concentration is 0.12%. They have an acute toxicity testing
requirement of 90% quarterly ( Feb, May, Aug & Nov) .

Application Renewal Comments and Explanations
Dear Ms. Sprinkle:
This NPDES Permit Renewal application is incomplete as described in the Renewal Requirements for
Municipal NPDES Permits due to a change in the wastewater treatment facility contract operation
provider and a change in the facility Operator in Responsible Charge in July 2009. Some information
required by the application is not on file with the Town and is unavailable from the previous ORC. The
information provided has been collected from July 2009 to May 2010.
This missing information is listed as:
1. Priority Pollutant Analysis information is reported from one (1) test conducted in November
2009 per the NPDES requirements. Additional PPA's may be tested over the next two (2) months
if required or on a schedule that you provide.
2. This application reports Aquatic Toxicity results from (3) toxicity tests. These are quarterly test
performed per the NPDES permit requirements beginning in July 2009. Toxicity testing is
scheduled for May 2010 and these results will be forwarded to you immediately upon receipt
from the laboratory.
3. CaCO3 analysis on the receiving stream as required by Section A.10.e is not included in the
application. This analysis will be performed the week of May 17th' 2010. The results will be
forwarded to you immediately upon receipt from the laboratory.
Please provide comments regarding the above information and your requirements as to the completion
schedule for this application.

Sludge Management Plan
The sewage sludge generated in the Town of Marshall wastewater Treatment
Facility is stabilized in an aeration basin the treatment process. In order to
produce a Class B product under EPA's 503 sludge regulations, the sludge is
retained for a total solids retention time of no less than 20 days or sufficient time
to achieve 40 percent volatile suspended solids reduction. The sludge is
dewatered using a HydroCal belt filter press. Ultimate sludge disposal is
accomplished using a sludge hauling contractor transporting sludge to a private
disposal contractor who disposes of the sludge in a permitted landfill.
Sludge production at the facility at the current flow rate is 200 tons per year.
The current contractors are:
Sludge Transportation: Madison County Solid Waste
Disposal Landfill: Lakeway "Class I" Landfill

RE: Town of Marshall -- WWTP Residuals TCLP Analysis
Dear Mr. Huff;
The Town of Marshall's WWTP has a very high level of solids within the various treatment components
of the WWTP. A high solids content makes it difficult to treat the wastewater properly, handle upsets
within the treatment works, and put additional stress on the pumps and motors within the plant. The
WWTP has a belt filter press which is used to dewater the solids into a sludge cake with a moisture
content of approximately 70%. The sludge cake must then be disposed of in accordance with NCDENR
regulations.
As required, a full TCLP analysis was performed on the residuals at the WW P in the Town of Marshall
and is attached (Attachment A) to this letter. TCLP is the acronym for Toxicity Characteristic Leaching
Procedure and is defined by the EPA in 40 CFR Section 261.24. This section is attached for your
reference in Attachment B. As you will find, every parameter tested was found to be below detectible
levels with the exception of cadmium. The allowable maximum concentration of cadmium in a TCLP
analysis is 1.0 mg/L, . The reported cadmium concentration was 0.077 mg/L, which is well below the
allowable concentration. The Town of Marshall's residuals do not exhibit any toxicity characteristics as
defined by the TCLP analysis.
The Town of Marshall, Mr. Don Byers of Byers Environmental and I will continue to work with you to
address any additional concerns with seeking a proper disposal method for these residuals. We
appreciate your input and guidance this far.
