Accordingly, we are forwarding the attached NPDES discharge permit. It is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007, or as subsequently amended. There are no changes to this final permit from the draft permit sent to you on January 18, 2012. The following changes have been made from the current permit: Footnote 2 regarding TRC has been updated per the Division's permitting strategy for TRC that accepts a TRC result from an NC accredited laboratory reported as less than 50 µg/ L as compliant with the permit. Monitoring for Total Zinc has been changed to Quarterly from Monthly based on RPA results. In keeping with EPA requirements, the requirement for an annual Priority Pollutant Scan has been changed to requiring three scans over the permit life. As of this permit issuance, any previously issued permit bearing this number is no longer effective. Discharge from said wastewater treatment works through Outfall 001 to the French Broad River (see attached map), a stream classified as Class B waters within the French Broad River Basin. Monthly average effluent concentrations for Biochemical Oxygen Demand (BOD5) and TSS shall not exceed 15% of the respective influent values (i.e. 85% removal). 2. TRC monitoring and limit requirements apply only if chlorine or a chlorine derivative is used in the treatment process. The facility shall report all effluent TRC values reported by a NC certified laboratory, including field certified. The permittee shall perform three Effluent Pollutant Scans during the term of this permit [ see A.(3)] Effluent shall contain no floating solids or foam visible in other than trace amounts. ACUTE TOXICITY PASS/FAIL PERMIT LIMIT (QRTR.LY) The permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the North Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity In A Single Effluent Concentration" (Revised -July, 1992 or subsequent versions). The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24 hour static test. The effluent concentration at which there may be at no time significant acute mortality is 90% (defined as treatment two in the procedure document). Effluent samples for self -monitoring purposes must be obtained during representative effluent discharge below all waste treatment. The tests will be performed during the months of February, May, August, and November. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGE6C. Additionally, DWQ Form AT-2 (original) is to be sent to the following address: Attention: North Carolina Division of Water Quality Environmental Sciences Section 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. Permit NCO021733 A (3). EFFLUENT POLLUTANT SCAN The Permittee shall perform a total of three (3) Effluent Pollutant Scans for all parameters listed below. One scan must be performed in each of the following years: 2012, 2013, and 2014. Analytical methods shall be in accordance with 40 CFR Part 136 and shall be sufficiently sensitive to determine whether parameters are present in concentrations greater than applicable standards and criteria. Samples should be collected with one quarterly toxicity test each year, and must represent seasonal variation [i.e., do not sample in the same quarter every. year]. Unless otherwise indicated, metals shall be analyzed as "total recoverable." II. Summary The Marshall W WTP discharges to the French Broad River. The 2011 French Broad Basin plan lists this portion [AU 6-(54.5)fl of the French Broad as impaired for turbidity, as 11.8% of samples from Ambient Monitoring Station E5120000 exceeded the standard of 50 NTUs. This encompasses 31.1 miles from Sandymush Creek to the North Carolina - Tennessee State Line. III. Compliance Summary DMR Data Review Monthly average DMR data was reviewed for the period of January 2009- October 2011. The data is summarized below in Table 1. The facility's average flows are currently at 18% capacity with the maximum monthly average flows at 20% capacity. NPDES Permit Fact Sheet — 03/05/ 12 Page 2 Town of Marshall WWTP NCO021733 RPA Analysis RPAs were performed using January 2009-October 2011 data for copper and zinc. Monitoring for those parameters is required in the NPDES permit. The facility does have a pretreatment program for one SfIJ: Deringer- Ney, Inc. This industrial user uses copper, cadmium, and silver to manufacture electrical contacts. However LTMP data was not included in the RPA analysis since data was not available for this renewal. Copper showed reasonable potential to cause an exceedance of water quality standards, however since this is an action level parameter it will not receive limits; monitoring will remain at monthly. Zinc did not show RP; sampling will be reduced to quarterly in conjunction with the WET testing. WET Test Results The Marshall W WTP has an acute pass/fail WET testing requirement. The facility has passed all tests administered since February 2007. Correspondence File Review/Compliance History Inspection reports prior to 2009 note several pieces of equipment that need repair, including the UV system, aerators, flow meter, clarifier, etc. There are also reports that routine housekeeping, grass cutting, and trimming is needed. A Compliance Inspection on 2/25/2011 reported that plant components have been repaired and placed back in service, and running as often as possible. Housekeeping had been vastly improved, the site cleaned up and the facility building had been painted. IV. In order to produce a Class B product under EPA's 503 sludge regulations, the sludge is retained for a total solids retention time of no less than 20 days or sufficient time to achieve 40 percent volatile suspended solids reduction. The sludge is dewatered using a HydroCal belt filter press. Ultimate sludge disposal is accomplished using a sludge hauling contractor transporting sludge to a private disposal contractor who disposes of the sludge in a permitted landfill. A high solids content makes it difficult to treat the wastewater properly, handle upsets within the treatment works, and put additional stress on the pumps and motors within the plant. The WWTP has a belt filter press which is used to dewater the solids into a sludge cake with a moisture content of approximately 70%. The sludge cake must then be disposed of in accordance with NCDENR regulations. As required, a full TCLP analysis was performed on the residuals at the WW P in the Town of Marshall and is attached (Attachment A) to this letter. TCLP is the acronym for Toxicity Characteristic Leaching Procedure and is defined by the EPA in 40 CFR Section 261.24. This section is attached for your reference in Attachment B. As you will find, every parameter tested was found to be below detectible levels with the exception of cadmium. The allowable maximum concentration of cadmium in a TCLP analysis is 1.0 mg/L, . The reported cadmium concentration was 0.077 mg/L, which is well below the allowable concentration. The Town of Marshall's residuals do not exhibit any toxicity characteristics as defined by the TCLP analysis. The Town of Marshall, Mr. Don Byers of Byers Environmental and I will continue to work with you to address any additional concerns with seeking a proper disposal method for these residuals.
