Army Corps of Engineers 3331 Heritage Trade Drive, Suite 105 Wake Forest, NC 27587 Subject: Application for Section 404 Nationwide Permit 14 and Section 401 Water Quality Certification for the Proposed Intersection Improvements at SR 2320 and Shepard School Road, Wake County Dear Mr. Phillips: On behalf of the Town of Zebulon, WSP USA has completed a Pre -Construction Notification (PCN) application for the proposed Intersection Improvements at SR 2320 and Shepard School Road project and requests reverification from the US Army Corps of Engineers (USAGE) and North Carolina Division of Water Resources (DWR) to use a Nationwide Permit 14 and the associated 401 Water Quality Certification (WQC) for impacts to jurisdictional Waters of the U.S. that will result from the project. A Nationwide Permit 14 was approved by the USACE on January 13, 2022 and a 401 WQC was approved by NCDWR on December 9, 2021 but the project was not started prior to permit expiration and construction has not commenced. The Town of Zebulon is seeking to improve vehicular and pedestrian safety at the SR 2320 (Old Bunn Road/Proctor Street) and Shepard School Road intersection by adding turn lanes, sidewalks, and pedestrian and traffic signals. The project design is the same as the previously permitted design with the exception of Impact Site S1. Changes at S 1 include installation of a Dominion Energy subsurface gas line relocation and additional stream bank stabilization. The gas line will cross the jurisdictional stream perpendicularly immediately upstream of the inlet of the proposed 48" culvert extension, and within the footprint of the previously approved channel stabilization impacts. The gas line crossing of the stream will be installed by open cutting the channel and back filling the trench. Stream impacts associated within this gas line installation will be contained wholly within the previously approved channel impact area, therefore, the gas line will not result in additional permanent loss of waters of the U.S. The gas line relocation will be conducted just prior to the culvert extension. The construction corridor for the gas line relocation will be limited to a width of 30 feet. In addition to the gas line, at Impact Site S1, 36 LF of temporary stream impacts included in the prior permit approval has been changed to permanent stream bank stabilization upstream of the proposed 48" culvert extension. This change was necessitated by the proximity of the roadway fill slopes to this channel. Any temporary impacts to the stream channel resulting from the gas line installation and stream bank stabilization will be restored to preconstruction contours. The design and impacts at Site S2 and Site S3 are unchanged from the previously permitted design. In total, the project will result in 83 linear feet (<0.01 acre) of permanent loss of stream (including 38 linear feet of jurisdictional ditch), 91 linear feet (<0.01 acre) of stream bank stabilization, 23 linear feet of temporary stream impacts (<0.01 acre), and 0.02 acre of temporary wetland impacts. The Town previously acquired mitigate credits for stream buffer impacts from the Kittrell Hill Mitigation Bank, including 1,594 square feet of Zone 1 impacts at a 3:1 ratio and 700 square feet of Zone 2 impacts at a 1.5:1 ratio. Catch basins will be installed along the curb and gutter and tie into the existing 30" RCP -III near Sta. 14+40. This crosspipe will be collared and extended to proposed roadway fill. By not replacing 30" RCP -III, impacts to Wetland (W1) are minimized to mechanized clearing for roadway construction. Impacts to JS are from pipe extension and channel stabilization at this site. Along Old Bunn Rd (-Y-), a proposed 48" RCP -III crosspipe will replace the existing 30" RCP. Permanent surface water mpacts to the JS, include rip rap at embankment where a lateral 'v' ditch outlets and channel stablization at the inlet of the proposed 48" RCP -III. At the outlet of the proposed 48" RCP -III, there is rip rap at the embankment at the outlet of the ditch along with pipe outlet channel stabilization.
