Division personnel have reviewed and approved your application for renewal of the subject
permit. Accordingly, we are forwarding the attached final NPDES discharge permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum
of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9,
1994 (or as subsequently amended).
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office- of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such
demand is made, this permit shall be final and binding.
Please take notice that this permit is not transferable. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits
required by the Division of Land Resources, Coastal Area Management Act, or any other Federal or
Local governmental permits which may be required.
In regard to your letter dated August 20, 2005, the implementation of the Total Residual
Chlorine requirement is federally mandated and the Division is implementing this statewide. This is
being handled during the renewal of permits as they expire, without exception (see enclosed memo).

In compliance with the provisions of North Carolina General Statute 143-215.1, other lawful standards
and regulations promulgated and adopted by the North Carolina Environmental Management
Commission, and the Federal Water Pollution Control Act, as amended, the
Waterford Place Property Owners Association
is hereby authorized to discharge wastewater from a facility located at the
Waterford Place WWTP
Music Camp Road
near Brevard
Transylvania County
to receiving waters designated as Hunts Branch in the French Broad River Basin in accordance with
effluent limitations, monitoring requirements, and other conditions set forth in Parts I, II, III and IV
hereof.
This permit shall become effective November 1, 2005.
This permit and authorization to discharge shall expire at midnight on September 30, 2010.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked, and as of this issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terms, and provisions included herein.
The Waterford Place Property Owners Association is hereby authorized to:
1. Continue to operate an existing 0.023 MGD wastewater treatment system with the following
components:
♦ Septic tanks
♦ Lift station
♦ Dosing tank with alternative siphons
e Dual surface sand filters
♦ Chlorine disinfection equipment
This facility is located near Brevard at the Waterford Place WWTP on Music Camp Road in
Transylvania County.
2. After receiving an Authorization to Construct from the Division, construct and operate a 0.046
MGD wastewater treatment system.
3. Discharge from said treatment works at the location specified on the attached map into Hunts
Branch, classified C waters in the French Broad River Basin.

We have thoroughly reviewed the draft permit for our Waterford Place water treatment facility.
The description of our system is correct, and the effluent limitations and monitoring requirements
are clear. We will comply with these requirements.
For the record, however, we fail to understand how any benefit will result from the total residual
chlorine limit. Effectively, this stipulates that there shall be no trace of chlorine in the effluent
discharge. Currently the level of chlorine in the discharge stream is very low, and dissipates
within a few feet of the discharge point. We have never observed any adverse impact upon fish
or organisms in the stream.
The installation of dechlorination equipment is expected to cost several thousand dollars.
Increased costs will be incurred in monitoring chlorine content and the purchase of
dechlorination chemicals. In a small community such as ours, these costs are not insignificant. It
is our understanding that these requirements have not been imposed upon much larger municipal
systems such as the one in Brevard.
We recognize that compliance is not optional and we will proceed on that basis, however some
explanation of the anticipated benefits of the TRC limits would be appreciated.

A request for renewal of the Waterford Place NPDES Permit NCO055905 is forwarded herewith
in compliance with your letter dated 29 November 2004. There have been no modifications of
the system during the past year.
We request that DENR drop the requirement in our sewer permit for upstream and downstream
sampling and monitoring for dissolved oxygen. The State initially required this in order to
establish a base line; we have had a perfect record for over 5 years for all parameters regarding
instream sampling and monitoring.
We also request that we no longer be required to monitor dissolved oxygen in our effluent. We
have never had a low dissolved oxygen reading and further, have a ladder (steps) in the effluent
discharge stream to add oxygen to the water.
We would also appreciate a change in our monitoring requirement for the effluent from a
bi-monthly basis to monthly. No problems have been noted in past test results.

ATTACHMENT 1 - TREATMENT SEQUENCE
1. Septic tanks - 1 per residential unit. Tanks are pumped on a 6-year cycle.
2. Lift Station - receives effluent from septic tanks - pumps to dousing tank.
3. Dousing Tank - sludge collects in the tank. Depth of sludge is currently less than 1/2 inch. If
the sludge reaches a level of 4 inches or more, it will be pumped out and sent to the Brevard
Sewerage Treatment Plant.
4. Sand Beds - effluent is released alternately to two sand beds for filtration. Sand is renewed
at periodic intervals and sent to the Transylvania County Landfill as biological waste.
5. Outfall Facility - Receives filtered effluent from the sand beds. Effluent is treated prior to
release by tablet -feed chlorination.
