Our intended actions regarding our land on Watertank Road are as follows. Upon
council with other entities in the area, we will not be pursuing a mining permit. We will
be grading our land and seeding it over. Given our winter climate here in the mountains
and considering that even today it is snowing, and has rained significantly this winter as
well, this takes time, which is why we had requested a 90 day extension to determine
what actions we were taking, and to start work. We will be seeding the land and can
only do so when weather is fitting and the ground is dry to be able to work on.

RE: Receipt of NOV Response
Dear Mr. and Mrs. Noblett:
This correspondence is an acknowledgement of the Notice of Violation(NOV) response letter dated January 16,
2023, received by the Winston-Salem regional office on January 27, 2023. This letter was submitted in
response to the Notice of Violation for mining without a permit issued on December 20, 2022.
As specified in the NOV, you were directed to provide a response to this correspondence with the proper steps
your business will take to either immediately stabilize the site or obtain a mining permit. As of the date of this
letter, we have not been provided sufficient response outlining your intended actions.
Violations of the Mining Act for mining without a permit are subject to a civil penalty of up to $5,000.00 per
day for each day of a continuing violation. A penalty may also be assessed for the violations outlined in the
NOV and continuing violations, ongoing after receipt of the NOV.
