FACILITY OVERVIEW:
This facility treats domestic waste from a single-family residence. The home is a three bedroom home and the
previously permitted Non -Discharge system was designed for 450 GPD discharge. The application submitted
changed the DWR application form to show 3 bedrooms @ 150 GPD/Bdr for 450 GPD. The usual allowance per
bedroom is 120 GPD which would set allowable discharge at 360 GPD. In an email on February 15, 2023 the
applicant and consultant were notified that the discharge permit for SFR is issued at 120 GPD/bedroom and the
permit will be issued with these restrictions. In a March 10, 2023 response letter the consultant acknowledged
that the allowable flow would be 360 gallons.
The property has an existing sand filter system that has been a part of a Non -Discharge Spray system
(WQ0002908) permitted by DWR. The current Non -Discharge system has a spray field that is located on land
owned by an adjacent property owner. There is an easement for continued use of the spray field. The owner
now wants to sell and the adjoining property owner with the spray field does not want to transfer the easement
for use of the spray field to a new property owner. In the add info email on February 15, 2023 the applicant and
consultant were asked for documentation that the property owner will not transfer the easement for the spray
field. The consultant's March 10tn response indicated that the permittee has tried multiple alternatives to reach
the landowner who lives outside the United States. There has been no response so the permittee is seeking a
discharge alternative.
To address this issue the permittee made application seeking coverage to allow discharge from the existing
sand filter system (with a few upgrades) under NCG550000. The system will discharge from the permittee's
property to a drainage ditch that goes into a UT that leads to a lake on an adjacent property. This ultimately
discharges to Little Creek in the Cape Fear River Basin.
PROPOSED IMPROVEMENTS AND CONSTRUCTION:
(See lower part of this section for Final permittee request for system.)
The existing system was originally proposed for upgrade to meet the NCG55 requirements by adding a contact
chamber and de -chlorination tablet feeder. Discharge piping, outlet and aerator were also to be installed. The
proposed system had the following components:
• Existing 1,200 Gallon Septic Tank with Effluent Filter and Riser (to be modified)
• Existing Surface Sand Filter
• Existing Tablet Chlorinator
• Chlorine Contact Chamber (to be added)
• De -Chlorination Tablet Feeder (to be added)

Existing Control Panel
Discharge Point with Rip Rap (to be added)
Some discussion in the project plans indicated that an effluent filter and access risers would be installed on the
existing septic tank if not already in place or if replacement is needed. Also appears that the septic tank and
pump tank will be evaluated for possible replacement if needed.
Initial application indicated that the proposed system included a dosing tank and recirculating sand filter.
Other discussion of system components did not seem to indicate a recirculating sand filter process. Additional
information was requested in a February 15, 2023 email.
Response (March 10, 2023 letter) to this add info request indicated that they initially thought the system was a
recirculating system but then found it was not. As part of the response the consultant noted that the permittee
could install anew system if this was an issue and provided plans and specifications for the new system. These new
plans were also referenced in response to a question about whether the design would require waivers from any
setback requirements. Division staff reviewed the information provided and responded to the consultant that the
proposed system in the original application could be installed since this is an existing permitted system, but also
gave the permittee the option to instead install the new system using the more recently submitted plans and
specifications. The permittee ultimately responded (March 16, 2023 email from AWT) that they preferred to install
the new system.
Final Plans In Accordance with March 10th Additional Info Response and March 16th Email from AWT
The final system approved here will consist of:
• 1,250 Gallon Septic Tank with Effluent Filter and Access Risers
• AdvantTex AX20-RT Treatment Pod With Re -circulating Chamber
• UV Disinfection System
• Control Panel with Alarm
• Discharge Outlet with Riprap
• All Piping and Appurtenances
HYDRAULIC TRESPASS
The discharge point is on the permittees property adjacent to the existing driveway. Discharge will be to a UT
leading to the lake on the adjacent property. There do not appear to be issues with Hydraulic trespass.
STAFF REPORT
Staff report completed by Jane Bernard (RRO) on January 13, 2023. The regional office noted in the staff report
that this was an existing non -discharge system losing access to offsite spray field. The region also indicated that
there were no onsite alternatives to the discharging system. The discharge was noted as being directly off of
owner's property into the UT leading to the adjacent lake. The Regional Office recommended approval of the
permit. Regional Office located outfall point at 35' 55' 18.3" / 78' 59' 32.2"

SFR irrigation systems. AWT soils evaluation does confirms that the site
soils are unsuitable due to expansive clay and shallow depth to soil
wetness. Adjoining properties are said to have the same soil issues.
Some potential systems would have room onsite, but soils would not
allow their use.
Wastewater Reuse
The location is not capable of reusing reclaimed water onsite or
becoming a bulk distributor of reclaimed water.
The applicant did consider adjacent land in the alternative's evaluations.
Availability ofAdjacent Land
Issues existed with either cost or the same soils issues as on the
applicant's current property
Even though information shows the discharge is to a zero -flow stream,
this is an existing system with no apparent alternatives. The applicant

will install a new AdvanTex treatment system with UV disinfection.
This is the cheapest proposed system but is also indicated as the only
technologically feasible alternative.
LOCAL GOVERNMENT REVIEW FORMS
The application package included copies of the forms submitted to the City of Chapel Hill and the County of
Durham. Certified mail slips to verify that the local governments had received the forms were included.
OTHER NOTES:
• Plans note flow from receiving stream will be prevented from backing up into outlet pipe and outlet pipe
will have grate.
• The application included a 2013 WQ0002908 permit as the current permit for the permittee. However, a
renewal was issued in September 2018 for this facility. In a February 15, 2023 email the consultant was
asked to assure that the permittee has the most recent permit. A link to the permit in Laserfiche was
provided.
• There is no discussion of setbacks for the proposed system to determine if setback waivers are required.
The February 15, 2023 add -info email asked about this issue. The March 10tn response and subsequent
change to the installation of a new treatment system will allow for a system that meets all setback
requirements.
• Since the treatment system installed is an approved pod type system and it is replacing an existing
permitted system, no formal review of the EAA by staff engineer was required.

Thanks for the responses, these are very helpful in finalizing our review. I just wanted to touch base on one thing so we
can get things finalized for the permit. You included updated plans and specifications for potentially installing a new
AdvanTex system if needed in response to a couple of our questions. Based on your responses and the fact that this is
an existing system, our review has concluded that you do not need to install a new system of this type. If, however, that
is what the applicant would like to do, we can take the recently provided information and issue the permit with the
updated treatment components. Could you please respond to me to verify your preference for moving forward. We
can either:
• Issue the permit in accordance with the original application plans and specifications, with the exception that the
ATC will be written for 3 bedrooms at 120 gallons per bedroom per day — 360 gallons per day total flow. Or,
• Issue the permit based on the updated plans and specifications with the new treatment system (again at 360
gallons per day total flow).
Sorry for the additional request, I just want to make sure that we move forward in the right manner.

Sorry but I forgot to mention one thing in the previous email.
• The NCG550000 application indicates (#7) that the system has a dosing tank and recirculating sand filter. In
other narrative descriptions in the material provided the system is described as a sand filter system but it isn't
clear that it is a recirculating system with a dosing tank. Could you please clarify this also.

I just wanted to touch base on the application review for this property. Below are a few questions/comments on the
application materials. Please take a look and respond to these issues.
• The application material indicates that the current non -discharge spray system has a spray field on adjacent
property and the spray field is not transferable. We assume that this means the permittee wishes to sell the
property and the adjacent landowner does not want to transfer the easement for use of the spray field to a new
property owner. The Division considers discharge permits as a last resort when no sewer or onsite non -
discharge alternatives are available. Can you please provide documentation that verifies why the offsite spray
field is not available for use with this system.
• The submitted application information is for a 3-bedroom home with flow of 450 gallons per day. For Single
Family Discharge systems under the discharge program, we consider allowable flow at 120 gallons per day per
bedroom. The Division will therefore consider this application for a flow limit of 360 gallons per day. The
application for the NCG55OOOO permit documents the 120 gallon per day limit per bedroom but the application
submitted had been modified to change the language to 150. In the future, please leave the application
information unchanged and note any requested differences and include discussion information in an attached
letter.
• The application material notes a current non -discharge permit from September 2013. Permit WQOOO29O8 was
reissued September 10, 2018. Since the permittee is still operating under this permit at this time, please assure
that they have access to the most current permit. You can access the permit at our Laserfiche site at:

• There is no discussion about any setback issues for the site so we are assuming that there is no need for any
setback waivers for the site. Is this correct?
• Is there any documentation available to show recent cleaning of the septic tank and pump tank? If so, could you
rovide these for our records as well.

hopefully provide more efficient service to our permittees and other partners and will allow us to more effectively
